Who is eligible for a settlement payment?

Class members must meet the following criteria:

  • You had an insurance policy with The General that provided unstacked uninsured and/or underinsured motorist coverage.
  • You added a new vehicle to your policy by endorsement (Amended Declarations Pages), rather than through the "Additional Acquired Auto" or "Newly Acquired Vehicle" clauses.
  • You submitted an injury claim to The General for uninsured or underinsured motorist benefits and your claim was denied.
  • The General did not obtain a new waiver of stacked UM/UIM coverage from you after adding the new vehicle.

How much will the insurance class action payout be?

  • Each approved claimant will have their uninsured or underinsured motorist claim they submitted to the The General individually evaluated.
  • The General will provide the claimant with a compensation offer, the amount based on the details of the individual policy and claim.
  • Claimants that disagree with The General's evaluation and monetary offer, can request to have a court appointed Special Master to review and issue a final and binding decision.

For example, if your original policy provided $50,000 in unstacked UM/UIM coverage, and stacking would have increased your coverage to $100,000, you could potentially receive up to the full $100,000, depending on your claim evaluation.

How to claim an class action settlement payment

To claim a class action rebate, you must submit a completed claim form by the deadline of July 7, 2025. Class members can access the claim form on the settlement website. The claim form can be submitted online, or you can download and print a claim form to mail in.
