CAPS Ohio $425,000 Data Breach Settlement

If you received a notification from Columbus Aesthetic and Plastic Surgery, Inc. (CAPS) regarding a data breach incident in September 2023, you may qualify to submit for a cash payment from a class action settlement.

CAPS has agreed to pay $425,000 to settle a class action lawsuit for allegedly failing to implement proper security measures to protect personal patient information of the 18,863 class members.

Who is eligible for a payout?

People who received a notification from CAPS about the data breach incident informing them that their private information may have been compromised in the data breach are eligible for a payout.

How much are settlement payments?

Class members can claim one or both of the following:

• Out-of-Pocket Losses: Up to $5,000 for documented expenses and monetary losses traced to the CAPS data breach
• Cash Payment: Estimated at $125, subject to a pro rata adjustment, based upon the number of valid claims filed

Is additional documentation required to qualify for a payout?

Some documentation is required:

• Claim Number and PIN from settlement notice is required to submit online or on the PDF claim form
• Out-of-Pocket Losses claims require documentation for each monetary loss or expense listed, such as receipts, bank/credit card statements, proof of professional services hired, ect.

How do I claim my payment?

To claim a settlement payment, class members must submit a claim form by the March 26, 2025 deadline. You can file a claim online or download the PDF claim form to print and mail to the settlement administrator.

• Approved paper claim forms mailed to the settlement administrator will have a check mailed to the address provided
• Approved online claim submitters can chose to receive an electronic payment or a mailed check

$425,000 Settlement fund

The settlement fund of $425,000 will cover various costs associated with the lawsuit and compensation for class members. The breakdown is as follows:

• Payments to approved claimants
• Settlement administration costs
• Attorneys' fees and expenses of up to $156,666.66
• Service awards for the class representative of up to $5,000.

When is the CAPS Data Settlement payout date?

The final approval hearing will take place on May 12, 2025. If the settlement is approved and there are no appeals, payments will be issued to approved claimants.
