Advanced Medical Transport has agreed to pay $482,090 to settle a class action lawsuit for alleged violations of the Biometric Information Privacy Act (BIPA) by collecting, storing, using, and disseminating biometric information without proper consent and written disclosures.
Can I Claim an Award?
To be eligible for an award, you must be an individual who worked for Advanced Medical Transport in the State of Illinois and used a finger scan timekeeping system in connection with your employment between May 11, 2018, and January 4, 2021. This group is collectively referred to as the "Settlement Class" and individually as "Settlement Class Members."
What Awards Can Class Members Claim?
Each Settlement Class Member who does not opt out of the settlement will be sent a Claim Settlement Check on a pro rata basis, not to exceed $920 per claimant. After the subtraction of a pro rata portion of any and all approved Notice and Administrative Costs, Service Awards, and Attorneys’ Fees and Expenses, it is estimated that each Settlement Class Member will receive a net amount of $500-$550.
For example, if the total administrative costs, service awards, and attorneys' fees amount to $100,000, and there are 500 claimants, the calculation would be as follows:
- Total Settlement Fund: $482,090
- Total Deductions: $100,000
- Net Settlement Fund: $382,090
- Amount per Claimant: $382,090 / 500 = $764.18
Is Proof Required to Claim the Reward?
Not applicable. Claimants do not need to proactively provide proof because the Settlement Administrator already has their information.
How to Claim Your Award
To claim your award, you do not need to do anything if you are a Settlement Class Member. The Administrator will mail you a settlement check if the Court grants Final Approval to the Settlement.
How do I Get Paid?
Payments will be made by check and mailed to the address on file for each Settlement Class Member.
