
If your Missouri home or property was insured by Liberty Insurance Corporation and you made a claim for structural loss between August 31, 2013, and October 31, 2022, you may be eligible to submit a claim for a payment from a class action settlement.
Liberty Insurance Corporation has agreed to pay to settle a class action lawsuit for allegedly improperly deducting nonmaterial depreciation when adjusting certain structural loss claims in Missouri.
Who is eligible for a settlement payout?
Policyholders must meet the following criteria to qualify to submit a claim:
- You were issued a non-commercial property policy in Missouri by Liberty Insurance Corporation between August 31, 2013, and October 31, 2022.
- You made a structural loss claim under Coverage A or B of your policy.
- A Symbility and/or Xactimate estimate was used in the determination of your payment.
- Nonmaterial depreciation was withheld, or it would have resulted in an ACV payment but for the withholding causing the calculated loss amount to drop below the deductible.
Who is excluded from the class?
Certain policyholders are excluded from the settlement. More exclusion information is available on the settlement website.
How much is the class action payment?
Payment amounts will be based on the nonmaterial depreciation withheld from ACV payments.
- Payment A: 90% of the nonmaterial depreciation withheld, plus 5% simple interest from the year the loss was reported through December 31, 2024.
- Payment B: Policyholders who had all nonmaterial depreciation subsequently paid, the payment is based on a schedule:
- $1 - $5,000: $25
- $5,001 - $10,000: $50
- $10,001 - $20,000: $100
- $20,001 - $40,000: $200
- $40,001 - $60,000: $300
- $60,001 - $80,000: $400
- Greater than $80,000: $500
How to claim a Liberty Insurance settlement payout
To claim a payment, you need to complete and submit a claim form by the deadline of July 7, 2025. You can file a claim online or download the PDF claim form and print and mail it to the settlement administrator.
Class members with more than one covered loss during the class period must submit a separate claim form for each loss.

Is proof required to submit a class action claim?
- Unique ID and PIN from notice required to submit online.
- Liberty policy number, claim number, and date of loss required.
- Policyholders that have signed a contract with another party to recover insurance benefits must attach a copy of the assignment contract.

A check will be mailed to class members with approved claims.
Class action settlement fund
The settlement fund will include
- Payments to approved claimants: Amount determined by number of submissions
- Settlement administration costs: Estimated to be $80,000
- Attorneys' fees and expenses: Up to $625,000
- Service award to class representative: $7,500

When is the Liberty Insurance settlement payout date?
The final approval hearing is scheduled for May 21, 2025. Once the settlement is granted approval by the court, claims will be processed and payments distributed to approved class members.
