Amazon and WDS $2M Unpaid Driver Wages Settlement

If you worked as a Delivery Associate and were paid by WDS Logistics, LLC or its affiliates to deliver packages for Amazon between February 28, 2016, and September 16, 2018, you may be receiving a monetary award from an employment settlement.

WDS Logistics, LLC, along with Amazon.com, Inc. and Amazon Logistics, Inc., has agreed to pay $2,000,000 for alleged driver unpaid wages and overtime compensation.

Who is eligible to receive a payment?

• WDS Delivery Associates paid by WDS Logistics, LLC or its affiliates to deliver Amazon packages in the United States
• Delivered packages to customers of Amazon.com at any time during the period from February 28, 2016, to September 16, 2018

These individuals are automatically included in the settlement and will receive a payment

How much will my WDS Amazon driver settlement payment be?

• Each class member will automatically receive a $50 payout
• Additional payments will be calculated based on the number of workweeks where each Class Member worked four or more days
• Every class member will receive one settlement share for each workweek with four or more days

• The total number of settlement shares will be divided into the remaining settlement amount to determine the per-share dollar amount
• 50% of each class member's payment will taxed as back wages

No action required to receive an Amazon driver settlement payment

Class members do not need to take any action to receive their settlement award. Payments will be sent automatically unless a member opts out of the settlement.

Settlement payout options

• Drivers that have not opted out of the settlement will receive a mailed check
• Drivers that prefer to receive their payment by PayPal or Venmo should submit an Electronic Payment form on the settlement website
• Claim Number and PIN from settlement notice required to submit

$2 Million settlement fund

The WDS Amazon driver settlement fund of $2,000,000 covers:

• Payments to qualifying drivers
• Settlement notice and administration costs
• Attorneys' fees and expenses of up to $691,666.67
• Service award to the Claimant that initiated this arbitration of $10,000
• Arbitration service fees of up to $10,000

Important dates

• Any disputes over eligible workweeks must be submitted to the settlement administrator by March 22, 2025
• Final Approval Hearing: April 21, 2025

When is the WDS Amazon Driver Settlement payout date?

The Final Approval Hearing scheduled for April 21, 2025. Settlement payments will be distributed to eligible drivers approximately 85 days after the court issues the final approval order

Why is there a class action settlement?

Arbitration occurred because WDS Delivery Associates delivering packages on behalf of Amazon were allegedly not paid for all hours worked, including overtime, as required by law. The settlement resolves these claims without further litigation.
