If you worked as an Assistant Manager or a non-exempt employee for Verizon outside of California, you may be eligible to claim a payment from a class action settlement.
Verizon has agreed to pay $8,500,000 to settle a class action lawsuit for alleged unpaid overtime and incorrect overtime rates related to Restricted Stock Units.
Who can file a claim?
To be eligible for this settlement:
- You worked as an Assistant Manager or a non-exempt employee for Verizon outside of California.
- Your employment must have occurred between January 6, 2020, and October 20, 2023.
- If you were employed in New York, the eligibility period extends from January 6, 2017, to October 20, 2023.
How much are the payouts?
The settlement provides varying payment amounts based on several factors, including job title, the number of productive weeks worked, and the strength of individual claims:
- Half of the payment is considered wages and is subject to taxes, reported on a W-2 form.
- The other half is reported on an IRS Form 1099.
- A minimum payment of approximately $20 is guaranteed for those whose calculated payment is less.
The exact amount each class member receives will depend on the allocation formula approved by the court. This formula considers the number of productive weeks worked, defined as weeks where at least 37 hours were worked, excluding any leave time.
How to claim an award
To claim your award, you must submit a claim form by filing a claim online by March 29, 2025.
Payout methods
Payments will be distributed via checks mailed to the address provided in the claim form.
$8.5 Million settlement fund
The settlement fund of $8,500,000 will cover payments to class members, attorneys' fees, and administrative costs. Attorneys' fees are one-third of the settlement amount and the lead plaintiff will receive a service award of $13,000.
Important dates
- Deadline to File a Claim: March 29, 2025
When is the Verizon Wage Settlement payout date?
Payments will be distributed within 31 days after the claim submission deadline of March 29, 2025.
Why is there a class action settlement?
The lawsuit alleged that Verizon failed to compensate employees for all hours worked and did not pay the correct overtime rate for those receiving Restricted Stock Units. Verizon denies these claims but agreed to settle to avoid further litigation.
