If you live in the United States and your private information was potentially compromised in a cybersecurity incident involving UNITE HERE, you may be eligible to submit a claim for a class action settlement.
UNITE HERE has agreed to pay $6,000,000 to settle a class action lawsuit for alleged negligence in protecting private information during a data breach that occurred on or about October 20, 2023.
Who qualifies for a settlement payment?
Individuals in the United States whose personal information was compromised as a result of the UNITE HERE cybersecurity incident that was discovered in October 2023.
How much is the UNITE HERE data breach payout?
Class members can submit a claim for one or more of the following:
- Reimbursement for Documented Out-of-Pocket Expenses: Up to $5,000 for expenses such as bank or credit card fees, and credit monitoring or other services incurred due to the data incident.
- Credit Monitoring: Two years of credit monitoring services.
- Pro Rata Cash Fund Payments: All class members can submit for a cash payment which will be distributed evenly after all other claims and expenses are paid. Payment amount will be determined by the number of valid claims filed.
How to claim a data breach settlement payment
To claim a UNITE HERE payout, class members must submit a claim form by the deadline of April 28, 2025. The form can be submitted online through the settlement website or downloaded as a PDF claim form and mailed to the settlement administrator.

$6 Million UNITE HERE data breach settlement fund breakout
The settlement fund of $6,000,000 will include the following:
- Settlement administration costs: Amount to be determined
- Attorneys' fees and expenses: Up to $2,000,000
- Service awards to the two class representatives: $7,000 total
- Credit Monitoring: Cost determined by the number of claims filed
- Payments to approved claimants

When is the UNITE HERE payout date?
The court will hold a final approval hearing on May 12, 2025. The judge must grant approval to the settlement. Once approved, claims will be processed and payments issued to approved claimants.
