United HealthCare Services, Inc. has agreed to pay $2,500,000 to settle a class action lawsuit for alleged violations of the Telephone Consumer Protection Act (TCPA).
UnitedHealthcare allegedly made prerecorded calls to cell phones without obtaining prior express consent, violating the TCPA. The parties agreed to settle to avoid the costs and uncertainties of continued litigation.
Who can get a payout?
To be eligible for a payout:
- You received a non-emergency telephone call using either the Avaya Pro Contact or LiveVox IVR dialing systems.
- The call was made by the Medicare and Retirement Non-Licensed Retention Team, the Community and State National Retention Team, or the Medicare and Retirement Collections Team.
- The call was made to a cellular phone through the use of an artificial or prerecorded voice.
- You were not a UnitedHealthcare member or a third party authorized to receive calls on a member’s behalf at the time of the call.
- These calls occurred between January 9, 2015, and January 9, 2019.
How much are the payouts?
Class members can expect to receive a payment ranging from $350 to $1,000.
The exact amount will depend on the number of valid claims submitted. The settlement fund will be distributed on a pro rata basis, meaning that each claimant will receive an equal share of the remaining funds after deducting costs, attorneys' fees, and service awards.
For example, if 1,000 valid claims are submitted, and $1,500,000 is available for distribution, each claimant would receive $1,500.
