Self Financial has agreed to pay $500,000 to settle a class action lawsuit for allegedly violating the Florida Consumer Collection Practices Act (FCCPA) by sending communications during prohibited hours.

Who are the class members?

To be part of this settlement, you must meet the following criteria:

  • Be a Florida resident.
  • Have received a communication from Self Financial or on its behalf between 9:00 PM and 8:00 AM.
  • The communication must be related to a consumer account.
  • The communication must have occurred between October 4, 2021, and the date of the Court's Final Approval Order.

How much can class members get?

Class members can claim a payment from the Settlement Fund, which is capped at $500,000. Each eligible class member who submits a valid claim form will receive a pro rata share of the fund, not exceeding $50.

  • Pro Rata Calculation: If the total valid claims exceed the Settlement Fund, each claimant will receive a proportionate share. For example, if 10,000 valid claims are submitted, each claimant would receive $50, assuming the total does not exceed the fund.

To claim an award, you must submit a completed claim form by October 29, 2024.

Payment methods

Payments will be issued via check to the address provided on the claim form.

Settlement Fund Breakdown

The settlement fund of $500,000 will cover:

  • Payments to eligible class members.
  • Notice and administration costs.
  • Attorneys’ fees and expenses up to $125,000.
  • A service award of $2,500 to the Class Representative.

When is the Self Financial payout date?

The Court will hold a Final Approval Hearing on October 14, 2024, to determine the fairness of the settlement. If approved, payments will be processed, and class members will be distributed within 60 days following the Effective Date, after all appeals are resolved.
