If you received notice from Sandridge Energy, Inc. that your personal information was potentially compromised in the data incident disclosed in March 2022, you may be eligible to claim up to $10,000 from a class action settlement.

Sandridge Energy, Inc. has agreed to pay $600,000 to settle a class action lawsuit for alleged negligent data security practices and breach of contract. This settlement resolves claims brought by customers impacted by the data incident, which resulted in the potential compromise of customers' personal identifying information (PII).

Who Can Claim an Award?

The Settlement Class includes all individuals who received a notice from Sandridge Energy, Inc. in or around March 2022, indicating that their personal information may have been accessed or exposed during the data security incident. This group of individuals is referred to as the Settlement Class Members.

What Awards Can Class Members Claim?

Settlement Class Members may file a claim for one or more of the following settlement benefits:

  • Cash Payment: As an alternative to filing a claim for reimbursement of Ordinary Losses, Attested Time Spent, or Extraordinary Losses, Settlement Class Members may submit a claim to receive a pro rata cash payment from the net Settlement Fund. It is currently anticipated that this cash payment will be $100, but this amount will likely increase or decrease depending upon the number of claims filed.
  • Documented Ordinary Losses: Settlement Class Members may submit a claim for documented out-of-pocket expenses fairly traceable to the Data Incident, up to $1,500 per individual. Ordinary Losses may include unreimbursed losses relating to fraud or identity theft, credit monitoring costs that were incurred on or after the Data Incident through the date of claim submission, and bank fees, long distance phone charges, postage, or gasoline for local travel.
  • Attested Lost Time: A Settlement Class Member who spent time remedying issues related to the Data Incident can receive reimbursement for up to ten (10) hours of lost time at a rate of $30 per hour with an attestation that they spent the claimed time responding to issues raised by the Data Incident. No documentation other than a description of their actions shall be required for members of the Settlement Class to receive compensation for attested time spent.
  • Documented Extraordinary Losses: Settlement Class Members are eligible for compensation for extraordinary losses resulting from the Data Incident, up to a maximum of $10,000, upon submission of a valid Claim Form and supporting documentation. Extraordinary Losses may include, without limitation, the unreimbursed costs, expenses, losses or charges incurred as a result of identity theft or identity fraud, falsified tax returns, or other possible misuse of Private Information.
  • Credit Monitoring: In addition to either the Cash Payment or the other monetary benefits, all Settlement Class Members will be offered the opportunity to claim a 3-year membership of 3-bureau credit monitoring with at least $1 million in fraud protection.

Is Proof Required to Claim the Reward?

Not applicable. The benefits are available only to Settlement Class Members with a unique ID.

How to Claim Your Award

To claim your award, you must complete and submit a Claim Form by August 7, 2024. Claim Forms may be submitted online or printed from the official settlement website and mailed to the address on the form. If you are only claiming credit monitoring or the cash payment, you may use the tear-off claim form attached to the postcard notice mailed to you.

Submitting a Claim

Follow these steps to submit a claim:

  1. Visit the official settlement website and download the Claim Form.
  2. Complete the Claim Form with your personal information, including your name, address, and email.
  3. Select the type of award you are claiming: Credit Monitoring, Compensation for Lost Time, Documented Ordinary Losses, Documented Extraordinary Losses, or Cash Payment.
  4. If claiming monetary losses, provide the necessary documentation to support your claim.
  5. Sign and date the Claim Form.
  6. Submit the Claim Form online or mail it to the Claims Administrator at the provided address.

How do I Get Paid?

Payments will be made via check or deposited into your PayPal, Venmo, or Zelle account, depending on the payment method you selected on the Claim Form.

$600,000 Settlement Fund

The total settlement amount is $600,000. This fund will be used to pay for all valid claims made by Settlement Class Members, notice and administration costs, service awards, and attorneys' fees and costs. In no event shall Sandridge pay more than $605,000.

  • Total Settlement Fund: $600,000
  • Attorneys' Fees: Not to exceed one-third of the Settlement Fund (i.e., not more than $200,000)
  • Service Awards to Class Representatives: $2,500 each
  • Remaining funds will be distributed to Settlement Class Members who submit valid claims

When will Awards be Paid?

Payments will be made after the Settlement is approved and becomes final (meaning there is no appeal from the order approving the Settlement).

Why is There a Class Action Settlement?

This class action settlement resolves claims brought by customers impacted by the data incident disclosed in March 2022, which resulted in the potential compromise of customers’ personal identifying information (PII). The lawsuit asserts common law claims against Sandridge for alleged negligent data security practices and breach of contract. Sandridge denied the allegations and denied that it would be found liable. The parties have now reached a proposed settlement of the lawsuit.

What Happens Next?

The Court will hold a Final Approval Hearing on August 16, 2024, to decide whether to approve the Settlement. If the Settlement is approved, payments will be made to eligible Settlement Class Members. Updates regarding the Settlement will be posted on the official settlement website.
