Robert Half International, Inc. has agreed to pay $4,375,719.32 to settle a class action lawsuit for alleged violations of the Fair Credit Reporting Act (FCRA) related to their background check practices.

Who is getting a payout?

Settlement class members eligible to receive a payout include those who:

  • Applied for temporary employment placement through Robert Half International, Inc. (RHI)
  • Had a consumer report obtained by RHI for employment purposes from General Information Services, Inc. between August 22, 2008, and November 30, 2017
  • The consumer report contained either a "red flag" or a "yellow flag"
  • RHI determined you were "not placeable" based on the background report

The class does not include individuals who applied for placement through RHI in June 2012 or later, signed the arbitration agreement acknowledgment form, and did not opt out of the arbitration agreement within 30 days. This ensures that only those affected by the alleged practices are included in the settlement class.

How much can class members get?

Each class member is entitled to receive a payment of $955.95. This amount is calculated based on the total settlement fund allocated for class member payments. The settlement fund is distributed equally among all eligible class members.

Class members do not need to take any action to receive their compensation. If the settlement is approved and becomes final, checks will automatically be mailed to the address maintained by RHI for each class member.

The settlement fund of $4,375,719.32 will cover various costs associated with the settlement:

  • Attorneys' fees: Amount to be determined by the court
  • Service awards to class representatives: $15,000
