If you received a notice from OrthoAlaska on or around October 11, 2023, indicating that your personal information may have been affected in a data incident, you might be eligible to claim up to $4,000 from a class action settlement.

OrthoAlaska, LLC has agreed to pay $1,185,000 to settle a class action lawsuit due to alleged mishandling of personal and health information during a 2023 cybersecurity incident that affected 161,130 people.

Who is eligible to file a claim?

Eligibility criteria:

  • You must have received a notice from OrthoAlaska about the data breach.
  • Your personally identifiable information (PII) and/or protected health information (PHI) must have been potentially accessed during the incident.
  • You must be listed on the Settlement Class List.
  • You must not have opted out of the settlement by the deadline.

The class members are individuals whose information, such as full name, address, Social Security Number, and health information, may have been impacted by the data breach.

How much are the payouts per person?

Class members can claim compensation for out-of-pocket losses up to $4,000. These losses include:

  • Unreimbursed expenses related to fraud or identity theft.
  • Professional fees, such as attorneys' fees and credit repair services.
  • Costs associated with freezing or unfreezing credit.
  • Miscellaneous expenses like notary, fax, postage, copying, mileage, and long-distance telephone charges.

In addition to compensation for out-of-pocket losses, class members can choose between:

  • Cash Fund Payment: A pro rata payment of up to $50 after other expenses are covered.
  • Privacy Shield: One year of data protection and monitoring services instead of the cash payment.
