Fred Meyer Stores, Inc. has agreed to pay $3 million to settle a class action lawsuit alleging violations of Oregon wage laws. The lawsuit claims that Fred Meyer violated these laws due to payroll errors caused by the activation of the MyInfo payroll system.
Alleged errors included missing or late paychecks, canceled direct deposits, incorrect wage rates, inaccurately recorded work hours, missing overtime pay, incorrect deductions, and delayed disbursement.
Who is eligible for a Fred Meyer settlement payment?
You are one of the 26,000 class members if you meet the following criteria:
- You were employed by Fred Meyer Stores, Inc. as an hourly paid, non-exempt employee.
- You worked in Oregon any time between September 25, 2022, and September 30, 2023.
How much is the class action payout?
The settlement offers two types of payments:
- Minimum Payment: Every class member will automatically receive a payment estimated between $50 and $100. No claim form required to receive a minimum payment.
- Additional Claims: Class members can submit additional claims if they experienced specific payroll issues between September 25, 2022, and December 31, 2022:
- Inaccurate Paychecks: Up to $200 if you identify one or more paychecks containing incorrect pay rates or inaccurately recorded work hours.
- Missing or Late Paychecks: Up to $200 if you identify one or more missing or late paychecks.
How to claim a Fred Meyer settlement payment
No claim form required to receive a Minimum Payment.
To claim an additional class action rebate, you must file a claim online or mail a written statement to the settlement administrator.
Your written statement must include:
- Your full name and current address.
- A statement that you are submitting a claim for an additional payment in the matter of Woody et al. v. Fred Meyer Stores, Inc.
- A list identifying the pay periods or dates of the paychecks you believe were missing, late, or inaccurate.
