If you are a U.S. resident who received a notice from Order Express, Inc. around December 15, 2022, regarding the potential impact of your information in a ransomware attack, you may be eligible to claim up to $6,500 from a class action settlement.

Order Express has agreed to pay $1,500,000 to settle a class action lawsuit for alleged negligence, breach of implied contract, declaratory judgment, and violation of California’s Consumer Privacy Act due to a ransomware attack that affected 63,220 people in the United States.

Who Can Claim an Award?

The settlement class includes all individual U.S. residents to whom Order Express, Inc. sent notice of the ransomware attack on or about December 15, 2022. This means if you received such a notice, you are likely part of the settlement class and eligible to claim an award.

What Awards Can Class Members Claim?

Class members can claim several types of awards, including cash payments and reimbursements for out-of-pocket losses. The awards are as follows:

  • Residual Cash Payment: Up to $550. This amount may be adjusted based on the total number of claims submitted.
  • Reimbursement of Ordinary Out-of-Pocket Losses: Up to $500 per individual for unreimbursed costs, losses, or expenditures incurred in responding to the notice of the ransomware attack between July 29, 2022, and the claims deadline.
  • Reimbursement of Extraordinary Losses: Up to $6,500 per individual for unreimbursed costs, losses, or expenditures that are fairly traceable to the ransomware attack and not reimbursable as ordinary out-of-pocket losses.
  • Attested Time: Up to 10 hours of time spent remedying issues related to the ransomware attack at a rate of $30 per hour.
  • Identity Theft Protection and Credit Monitoring Services: Five years of services.

For example, if you incurred $300 in costs for credit monitoring services and $200 in other miscellaneous expenses, you could claim a total of $500 for ordinary out-of-pocket losses. If you also spent 5 hours remedying issues at $30 per hour, you could claim an additional $150 for attested time.

Is Proof Required to Claim the Reward?

Yes, proof is required to claim certain awards. Claimants need to provide documentation to support their claims for ordinary out-of-pocket losses, extraordinary losses, and attested time.

  • For ordinary out-of-pocket losses: Receipts or other documentation not self-prepared that documents the costs incurred.
  • For extraordinary losses: Receipts or other documentation not self-prepared that documents the unreimbursed costs, losses, or expenditures incurred.
  • For attested time: An attestation and a brief description of the actions taken in response to the ransomware attack and the time associated with each action.
