If you were notified by Onix Group, LLC or an affiliate that your private information may have been compromised, you may be eligible to claim an award from a class action settlement.

Onix Group, LLC has agreed to pay $1,250,000 to settle a class action lawsuit for alleged inadequate protection of private information during a March 2023 data breach. Between March 20, 2023, and March 27, 2023, an unauthorized user accessed files within Onix's computer systems.

As a result, private information of individuals who were patients or otherwise affiliated with Onix may have been accessed. This information could include names, Social Security numbers, clinical information, and other medical or personal health information.

Who Can Claim an Award?

To be eligible for the settlement, you must be:

  • A residents of the United States whose private information was compromised in the data incident disclosed by Onix on or about May 26, 2023.
  • you were sent notice of the data incident.

What Awards Can Class Members Claim?

Class members can claim one of the following three options:

  • Credit Monitoring and Insurance Services (CMIS): One year of credit monitoring and insurance services, including up to $1 million of identity theft insurance coverage and three-bureau credit monitoring.
  • Documented Loss Payment: Up to $5,000 for reimbursement of documented losses incurred as a result of the data incident.
  • Cash Fund Payment: A pro rata cash payment, the amount of which will depend on the number of valid and approved claims submitted.

The credit monitoring and insurance services provide protection from unauthorized use of your personal information. If you already have credit monitoring services, you can still sign up for this additional protection. The documented loss payment is for unreimbursed losses and expenses related to identity theft and fraud resulting from the data incident. The cash fund payment amount will vary depending on the number of valid claims submitted.

Is Proof Required to Claim the Reward?

Yes, proof is required to claim the reward. Claimants need to provide reasonable documentation supporting their claims for documented losses. This includes written documents such as credit card statements, bank statements, invoices, telephone records, and receipts.

How to Claim Your Award

To claim your award, you can file a claim online by visiting the online claim form. Alternatively, you can download, print, and complete a claim form and mail it to the settlement administrator at the following address:

Submitting a Claim

Follow these steps to submit a claim:

  1. Visit the online claim form or download and print the claim form.
  2. Complete the claim form with your personal information and select the type of award you are claiming.
  3. If claiming a documented loss payment, provide reasonable documentation supporting your claim.
  4. Submit the completed claim form online or mail it to the settlement administrator at the provided address.

How do I Get Paid?

Once your claim is approved, you will receive an email prompting you to select your payment method. You can choose to receive payment via digital payment methods such as PayPal or Venmo, or you can elect to receive a check by mail.

$1,250,000 Settlement Fund

The total settlement amount is $1,250,000. This amount will be used to pay for the following:

  • Credit Monitoring and Insurance Services claims.
  • Documented Loss Payment claims.
  • Cash Fund Payment claims.
  • Settlement administrative expenses.
  • Court-approved service awards for named plaintiffs.
  • Attorney's fees and costs.

Class counsel will seek attorneys' fees up to a maximum of one-third of the settlement fund, which is $416,666.66, plus reasonable costs and expenses. Service awards of up to $1,000 will be given to each of the class representatives.

The class action settlement was reached because Onix Group, LLC allegedly failed to adequately protect the private information of individuals who were patients or otherwise affiliated with Onix.

Between March 20, 2023, and March 27, 2023, an unauthorized user accessed files within Onix's computer systems, compromising private information such as names, social security numbers, clinical information, and other medical or personal health information.

What Happens Next?

The court will hold a final approval hearing on November 20, 2024, to determine whether the settlement is fair, reasonable, and adequate. If the court approves the settlement, the settlement administrator will begin processing and distributing the awards to eligible class members.
