
If you had an auto insurance policy with Farm Bureau Property & Casualty Insurance Company and submitted a first-party property damage claim for a total loss, you may be eligible to submit a claim for a class action settlement.
Farm Bureau has agreed to pay $4,200,000 to settle a class action lawsuit for allegedly failing to fully compensate policyholders for sales tax and regulatory fees in total-loss auto claims.
Who is eligible for a payout?
You are a class member if:
- You had an auto insurance policy with Farm Bureau Property & Casualty Insurance Company covering private-passenger auto physical damage
- You submitted a first-party property damage claim determined by Farm Bureau to be a total loss between July 26, 2018 through November 30, 2024
- You did not receive full payout for sales tax and/or regulatory fees
How much is the Farm Bureau total loss settlement payment?
Claimants can receive 100% of the sales tax and 100% of the regulatory fees necessary to purchase a comparable vehicle:
- Sales Tax: Nebraska state sales tax of 5.5% plus local sales tax up to 2.5%
- Regulatory Fees: Includes motor vehicle tax, motor vehicle fee, local wheel tax, registration fee, plate fee, additional registration issuance fee, and title fee
How to claim a Nebraska Total Loss Settlement payout
To claim an award, class members must submit a claim form by April 30, 2025. You can file a claim online or download and print the PDF claim form and mail it to the settlement administrator.

When is the Burklund v. Farm Bureau payout date?
There is a final fairness hearing is scheduled for March 31, 2025. According to the settlement agreement, payments will be mailed to approved claimants approximately 100 days after the court grants final approval.
Why is there a total loss class action settlement?
The lawsuit alleges that Farm Bureau failed to fully compensate policyholders for sales tax and regulatory fees in total-loss claims. The settlement resolves these allegations without admitting liability and avoids the possibility of a trial.
