If you used a fingertip-scan timeclock or had your temperature taken using a scanner at Magid's facility in Romeoville, Illinois, between January 8, 2016, and August 30, 2024, you may be eligible to claim up to approximately $3,244.38 from a class action settlement. Magid Glove & Safety Manufacturing Co., LLC has agreed to pay $5,175,000 to settle a class action lawsuit for alleged violations of the Illinois Biometric Information Privacy Act (BIPA) by capturing biometric data without consent.

Who are the class members?

To determine if you are a class member eligible for compensation, consider the following criteria:

  • You worked at Magid's Romeoville, Illinois facility.
  • You used a fingertip-scan timeclock to clock in or out of work.
  • You had your temperature scanned at the facility.

These activities must have occurred between January 8, 2016, and August 30, 2024. If you received a notice about this settlement, it indicates that you are likely a class member.

Who is excluded from the class?

Individuals who properly execute and file a timely request for exclusion from the Settlement Class by October 29, 2024, will not be included in the settlement and will not receive any benefits.

How much can class members get?

The settlement offers different compensation amounts based on the type of biometric data collected:

  • Fingertip-scan timeclock users: Eligible for up to approximately $3,244.38.
  • Temperature scan recipients: Eligible for up to approximately $135.26.

The exact payment amounts may vary depending on the number of claims and other settlement expenses. If you used both systems, you are entitled to both payments.

How to claim benefits

Current or former employees do not need to submit a claim form to receive their settlement payment.

However, temporary workers must submit a claim form by November 19, 2024, to receive their benefits.

As of the date of publishing, the claim form for temporary workers is not yet available on the settlement website.

Payment methods

Payments will be issued via check to eligible class members.

$5,175,000 Settlement Fund

The settlement fund of $5,175,000 will cover:

  • Payments to class members.
  • Attorneys' fees, which may be up to 33% of the fund.
  • Litigation expenses.
  • An incentive award of $17,500 for the Class Representative.

When is the Magid Glove & Safety Mfg. Co. Settlement payout date?
