If you were a patient of a Luxottica-owned or affiliated eye care practice in the United States, you may be eligible to claim benefits from a class action settlement.
Luxottica of America Inc. has agreed to settle a class action lawsuit due to alleged unauthorized access to personal identifiable information (PII) and personal health information (PHI) of its patients in a data breach.
Who can file a claim?
To be eligible for this settlement, you must meet certain criteria.
The settlement class includes:
- Individuals who received a notice indicating their information was affected by the data breach.
- Patients of a Luxottica-owned or affiliated eye care practice in the U.S. who scheduled an appointment on or before August 5, 2020.
The class members are divided into two categories based on the type of information impacted:
- Category One: Members whose Social Security numbers and/or financial data were potentially impacted.
- Category Two: Members whose Social Security numbers and/or financial data were not impacted.
How much can class members get?
- Category One Benefits
- Members can claim out-of-pocket loss reimbursement, lost-time claims, two years of three-bureau credit monitoring, a cash payment, and an additional $50 for California residents.
- The cash payment is subject to pro rata calculations, meaning the amount may increase or decrease based on the number of valid claims.
- Category Two Benefits
- Members can claim out-of-pocket loss reimbursement, lost-time claims, and a $50 cash payment for California residents.
- The total benefits for Category Two are capped at $300 per member.
Pro Rata Calculations
For Category One, the cash payment is distributed on a pro rata basis from the $250,000 fund. For example, if the total valid claims exceed the fund, each claimant's payment will be adjusted accordingly. Conversely, if fewer claims are submitted, the payment per claimant may increase.
What proof is required to submit a claim?
Claimants need to provide documentation for out-of-pocket losses, such as receipts or other proof of expenses related to the data incident. For lost-time claims, claimants must attest to the time spent dealing with the incident.
- Category One: Requires documentation for out-of-pocket losses and an attestation for lost-time claims.
- Category Two: Similar requirements as Category One, with a cap on total benefits.
