Who are the class members?
The class members include individuals who faced denial of claims or precertification requests for artificial insemination services by Aetna between September 1, 2017, and May 31, 2024.
The settlement identifies several categories of class members:
- Category A: Members whose files show denied claims for artificial insemination codes and may be eligible for settlement benefits.
- Category B: Members with denied claims but insufficient information to confirm LGBTQ+ relationship status.
- Category C: Members with IVF claims but unclear artificial insemination history and insufficient information to confirm LGBTQ+ relationship status.
- Category D-A: Members whose denied claims were later approved within 90 days, with files indicating potential eligibility.
- Category D-B: Members with denied claims later approved, but insufficient information to confirm LGBTQ+ relationship status.
How much can class members get?
Class members can receive an approximate $10,000 payment from the settlement fund.
However, if there are more than 200 class members, the amount may be proportionately reduced. Additionally, members may receive a $2,300 Default Dollars for Benefits Amount if Aetna has not already compensated for artificial insemination expenses.

- Category B and C Members: Must submit an Attestation Form.
- Category C and D Members: Must submit a Claim Submission Form with supporting evidence of services received.
How to claim compensation
- Category A Members: Automatically receive the payment if they do not opt-out.
