Incode Technologies $4 Million BIPA Settlement

If you were in Illinois and uploaded a selfie and a photo ID to a mobile app or website for identity verification performed by Incode Technologies, Inc. between November 11, 2018, and August 5, 2024, you may be eligible to claim $65 to $240 from a class action settlement.

Incode Technologies has agreed to pay $4 million to settle a class action lawsuit for allegedly collecting biometric data without complying with the Illinois Biometric Information Privacy Act (BIPA).

Who can file a claim?

To be considered a class member:

You uploaded a selfie and a photo ID to an app or website operated by an Incode customer.
This action took place while you were in Illinois.
The upload occurred between November 11, 2018, and August 5, 2024.
You did not execute a BIPA consent naming Incode.

If you received a notice of the settlement via email or mail, it indicates you are likely a class member.

How much can class members get?

Class members can claim a cash payment estimated between $65 and $240. The exact amount depends on the number of valid claims submitted.

The settlement fund of $4,000,000 will be distributed among class members after deducting settlement expenses, attorneys’ fees (38% of the settlement fund), and a $10,000 incentive award for the class representative.

Pro Rata Distribution: The settlement payments will be distributed equally among all valid claims. For example, if 10,000 valid claims are submitted, each claimant would receive approximately $240 before deductions. If 50,000 claims are submitted, the amount per claimant would be closer to $65.
