Incode Technologies, Inc. has agreed to pay $4,000,000 to settle a class action lawsuit for allegedly violating the Illinois Biometric Information Privacy Act (BIPA) by collecting biometric data without proper consent.

Who can file a claim?

To be considered a class member:

• You were located in Illinois.
• You uploaded a selfie and a photo ID to an app or website operated by a customer of Incode Technologies.
• This occurred between November 11, 2018, and August 5, 2024.
• You did not execute a BIPA consent naming Incode Technologies.

How much can class members get?

Class members can claim an award estimated to be between $65 and $240. The exact amount depends on the number of valid claims submitted.

The settlement fund of $4,000,000 will be distributed pro rata among claimants after deducting notice and administration costs, attorneys' fees, and incentive awards. For example, if 10,000 valid claims are submitted, each claimant might receive $240. If 50,000 claims are submitted, the amount could be closer to $65.

What is a Pro Rata Distribution? The settlement amount is divided equally among all valid claims. If fewer claims are submitted, each claimant receives a larger share, and vice versa.
