If you purchased certain Similasan, CVS, or Walgreens homeopathic eye products in the United States between September 11, 2017, and February 20, 2025, you may be eligible to submit a claim for up to $10 or more from a class action settlement.

Similasan Corporation has agreed to pay $3,575,000 to settle a class action lawsuit for alleged deceptive labeling and advertising practices. The lawsuit, titled Plowden, et al. v. Similasan Corp., claims that the company marketed certain homeopathic eye products as "homeopathic" without obtaining proper approval from the U.S. Food and Drug Administration (FDA).

Additionally, the lawsuit alleges that these products were not manufactured according to Current Good Manufacturing Practices, were misleadingly advertised as sterile, and failed to disclose potential risks associated with the ingredient silver sulfate.

Who is eligible for an eye drop settlement payout?

  • You purchased at least one of the covered homeopathic eye products listed below in the United States and its territories.
  • The purchase occurred between September 11, 2017, and February 20, 2025.
  • The products purchased were for personal use only, not for resale.

How much is the class action payment?

  • Without Proof of Purchase: Class members can claim up to a maximum of 4 products per household, at $2.50 per product, totaling $10 per household.
  • With Proof of Purchase: You can claim $2.50 per product with no limit on the number of products claimed, as long as proof of purchase for each claimed product is provided.

Final claim payout amounts will be adjusted on a pro rata basis, determined by the number of claims filed.

How to claim a Similasan, CVS, & Walgreens payout

To receive a class action rebate, you must submit a claim form. Class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

Required proof

With Proof of Purchase claims require supporting documentation such as store receipts, frequent shopper program records, or packaging that documents a Covered Product purchase on or before February 20, 2025.

$3.58 Million eyedrop class action settlement fund

The settlement fund of $3,575,000 will include:

  • Attorneys' fees: Up to $1,191,666.67
  • Attorneys' litigation expenses: To be determined
  • Service awards to the three class representatives: $2,500 each, totaling $7,500
  • Settlement administration costs: At least $280,000
  • Payments to approved claimants: Remaining settlement balance

When is the Homeopathic Eye Drop settlement payout date?

The final hearing is scheduled to take place on July 17, 2025. Payments to class members with valid claims will be issued after the court grants final approval, the claim deadline has passed, and processing is complete.

Why did CVS, Walgreens & Similasan agree to settle this class action?

The lawsuit alleged that Similasan deceptively marketed certain eye products as homeopathic without proper FDA approval, failed to comply with manufacturing standards, falsely advertised sterility, and did not disclose risks associated with silver sulfate.
