Northland Restaurant Group has agreed to pay $603,200 to settle a class action lawsuit for alleged violations of the Biometric Information Privacy Act (BIPA) by capturing and storing biometric information without proper consent and disclosures.
The class members include individuals who:
- Worked for Northland Restaurant Group, LLC in Illinois.
- Used a finger scan timekeeping system without executing a written consent.
- Were employed from July 31, 2018, to the present.
Class members can receive a payment ranging from $750 to $850. The settlement fund of $603,200 will be distributed on a pro rata basis, not exceeding $1,355.50 per claimant before deductions for fees and costs.
After deductions, the estimated net amount is between $750 and $850 per class member.
Pro Rata Calculation: The total settlement fund is $603,200. After deducting attorneys' fees, service awards, and administrative costs, the remaining amount is divided among the class members. For example, if there are 500 eligible claimants, each would receive approximately $1,206.40 before deductions. After estimated deductions, the net amount would be between $750 and $850.
Class members do not need to take any action to receive their payment. The Settlement Administrator will automatically mail checks to eligible members once the settlement is approved.
The Court will decide whether to approve the settlement at the Final Approval Hearing on October 7, 2024. If approved, payments will be distributed to class members within 30 days after the hearing.
