Eli Lilly and Company has agreed to pay $2,400,000 to settle a class action lawsuit for alleged age discrimination in hiring practices. This settlement is intended to benefit individuals who applied for employment as Primary Care Sales Representatives in the Lilly Diabetes and Obesity Business Unit (formerly known as the Diabetes Business Unit) between January 1, 2017, and June 30, 2020, and were denied employment.

Can I Claim an Award?

If you meet the following criteria, you may be eligible to claim an award:

  • You applied for a Primary Care Sales Representative position in the Lilly Diabetes and Obesity Business Unit between January 1, 2017, and June 30, 2020.
  • You were denied the position.
  • You were 40 years of age or older at the time of the denial.

What Awards Can Class Members Claim?

The settlement fund of $2,400,000 will be distributed pro rata among the eligible claimants. The exact amount each claimant will receive depends on the number of valid claims submitted. The claims administrator will notify claimants of their monetary award approximately three months after the claim deadline.

The process of determining and distributing the awards will take some time, and claimants should not expect to receive their awards until early 2025.

Is Proof Required to Claim the Reward?

Yes, proof is required to claim an award. Claimants must complete a Claimant Questionnaire to confirm their eligibility. The questionnaire will ask claimants to verify that they applied for and were denied a Primary Care Sales Representative position in the specified business unit during the relevant time period and that they were 40 years of age or older at the time of the denial.

How to Claim Your Award

To claim your award, you must complete a Claimant Questionnaire. You can submit the questionnaire electronically or you can complete and return the questionnaire via mail to the address provided on the official settlement website. The deadline to submit the questionnaire is July 29, 2024.

After submitting the questionnaire, the claims administrator will review your submission and notify you of your eligibility and the amount of your award, if any. You will then need to sign and return a release of claims and a W-9 form to receive your monetary award.

How Do I Get Paid?

Once the claims administrator has received all the necessary documentation, including the signed release of claims and W-9 form, they will move the Court to approve the distribution of the settlement funds. After the Court's approval, the claims administrator will issue checks to the eligible claimants. The entire process may take several months, and checks are expected to be issued in early 2025.

Why Is There a Class Action Settlement?

The EEOC filed a lawsuit in September 2022, alleging that Eli Lilly and Company and Lilly USA, LLC engaged in a pattern or practice of age discrimination by failing to hire applicants age 40 and over for Sales Representative positions during the period from January 2017 through December 2021. The lawsuit claimed that this practice violated Section 4 of the Age Discrimination in Employment Act of 1967 (ADEA).

The settlement resolves these allegations without any admission of wrongdoing by Eli Lilly and Company. The next steps involve the claims administration process, where eligible claimants will be notified of their awards and required to submit the necessary documentation to receive their monetary relief.
