Cooper Clinic, P.A., Cooper Medical Imaging, LLP, and Cooper Aerobics Enterprises, Inc. (collectively known as "Cooper") have agreed to pay $1.3 million to settle a class action lawsuit alleging that they failed to adequately protect personal information, resulting in a data breach.

The breach occurred around February 3, 2023, when unauthorized cybercriminals accessed Cooper's computer systems. The compromised information potentially included personal details such as names, addresses, dates of birth, social security numbers, and other information.

Who can claim a payout?

To be eligible, you must:

  • Be a U.S. resident
  • Have received a notification from Cooper stating your personal information was accessed, stolen, or compromised during the data breach

How much are the payouts?

The settlement provides multiple types of compensation depending on the losses you experienced and the documentation you can provide:

  • Ordinary unreimbursed losses:
    • Up to $1,500 for documented ordinary losses directly related to the data breach. Eligible expenses include:
      • Bank fees
      • Long-distance phone charges
      • Cell phone charges (if charged by the minute)
      • Data charges (if charged based on data usage)
      • Postage
      • Gasoline for local travel
      • Fees for credit reports, credit monitoring, or identity theft insurance
  • Extraordinary unreimbursed losses:
    • Up to $5,000 for documented extraordinary losses directly caused by identity theft or fraud resulting from the breach. To qualify, you must provide documentation proving:
      • Actual monetary loss supported by third-party documentation
      • Loss resulting from identity theft, fraud, or similar criminal victimization
      • Loss more likely than not caused by the data breach
      • Loss not already covered by ordinary losses or time spent categories
      • Reasonable efforts made to avoid, mitigate, or seek reimbursement for the loss, including exhausting available credit monitoring and identity theft insurance
  • Time spent addressing the breach:
    • Up to $100 total, calculated at $25 per hour for a maximum of four hours. You must submit a statement detailing how the time was spent addressing the breach.
  • Alternative cash payment:
    • A flat payment of $50 is available if you choose not to claim ordinary, extraordinary losses, or time spent. No documentation or attestation is required for this option.
  • Credit monitoring services:
    • Two years of free credit monitoring and identity protection services from three credit bureaus, including:
      • Credit report and score
      • Dark web monitoring
      • Identity protection services
      • Identity resolution services
      • $1,000,000 in identity theft insurance

How to claim a payout

To receive a payout, you must file a claim online or submit a paper claim form by mail. You can download a paper claim form by visiting the online claim form link, entering your claim ID and PIN, and you will have the option to download the claim form.

$1.3 Million settlement fund

The settlement fund of $1,300,000 will cover:

  • Attorneys' fees: Up to $390,000 (30% of the settlement fund)
  • Attorneys' expenses: Up to $15,000
  • Service awards to class representatives: Up to $2,500 each
  • Settlement Administration: TBD
  • Payments to class members: Remaining amount

When is the Cooper Clinic Data Breach Settlement payout date?

The court will hold a Final Approval Hearing on June 20, 2025, to determine if the settlement is fair, adequate, and reasonable. If the court approves the settlement, payments will be distributed shortly thereafter. If the settlement is not approved or is reversed on appeal, the litigation will continue.
