If you purchased electronic tickets to Color Factory NYC between August 29, 2022, and January 23, 2024, you may be eligible to claim a portion of a $714,705.68 settlement from a class action lawsuit.

Color Factory, LLC has agreed to settle a class action lawsuit for alleged failure to properly disclose a fee for electronic tickets to its Color Factory NYC prior to those tickets being selected for purchase.

Who can submit a claim?

To be a part of the settlement class, you must meet the following criteria:

  • You purchased electronic tickets to Color Factory NYC.
  • You paid a fee in connection with the ticket purchase.
  • The purchase was made from the Defendant’s website, https://www.colorfactory.co/.
  • The purchase occurred between August 29, 2022, and January 23, 2024.

How much can class members get?

The settlement fund of $714,705.68 will be distributed among the eligible class members based on the total amount of fees they paid.

The exact amount each class member will receive depends on the total number of valid claims submitted and the total fees paid by each claimant.

The settlement amount will be divided pro rata among all valid claims.

Is proof required to submit a claim?

No, claimants do not need to proactively provide proof they are a class member. Instead, they can claim an award by attesting they are a class member, under penalty of perjury. Only submit a claim if you are an actual class member.

How to claim an award

Claim instructions

Follow these steps to submit your claim:

  1. Visit the online claim form.
  2. Enter your unique ID received via email or postcard notice from the Settlement Administrator. If you do not have a unique ID, contact the Settlement Administrator to obtain one.
  3. Fill out the claim form with your personal information and select your preferred payment method (PayPal, Venmo, Zelle, or check).
  4. Attest under penalty of perjury that you purchased electronic tickets to Color Factory NYC and paid a fee in connection with such purchase during the specified period.
  5. Submit the form online and keep a copy of the confirmation code for your records.
  6. If you prefer to file by mail, download the claim form, fill it out, and mail it to the address provided above.

The settlement fund of $714,705.68 will cover:

The attorneys’ fees and costs may be up to one-third of the settlement fund, and the Class Representative may receive a service award of $5,000.

When is the Color Factory Ticket Fee Settlement payout date?

If the Court approves the settlement, eligible Settlement Class Members will receive their payment 60 days after the Defendant makes its last installment payment into the Settlement Fund.

Why is there a class action settlement?

The lawsuit claims that Color Factory, LLC failed to properly disclose a fee for electronic tickets to its Color Factory NYC prior to those tickets being selected for purchase, in alleged violation of New York Arts and Cultural Affairs Law § 25.07(4). The Defendant denies any wrongdoing but has agreed to settle to avoid the uncertainties and expenses associated with ongoing litigation.

What happens next?

The Court will hold a Final Approval Hearing on November 6, 2024, to determine whether the settlement is fair, reasonable, and adequate. If approved, payments will be processed and distributed to eligible class members as outlined.
