If you received a notice from CentraState Healthcare System, Inc. in or around February 2023 about a data security incident, you may be eligible to claim an award from a class action settlement.

CentraState Healthcare System, Inc. has agreed to pay $3,000,000 to settle a class action lawsuit for alleged failure to adequately protect personal and health information and provide timely notice of a data security incident.

Can I Claim an Award?

To be eligible for an award, you must be a Settlement Class Member. You are a Settlement Class Member if you are a person in the United States whose information was maintained on the CentraState systems impacted by the December 2022 data security incident, and you received a notice from CentraState in or around February 2023 concerning the incident.

The Settlement Class includes approximately 569,984 individuals whose personal and health information may have been accessed during the incident. The information potentially accessed includes names, addresses, Social Security Numbers, dates of birth, health insurance information, and other medical records.

What Can I Get From This Settlement?

If the Settlement is approved and becomes final, it will provide Settlement Class Members with the following benefits:

  • Three years of comprehensive Medical Data Monitoring services provided through CyEx by Pango Group.
  • Cash benefit payment, depending on the participation rate for the Settlement, which will be a pro rata share of the remaining Net Settlement Fund.
  • Cash payment of up to $3,000 for documented Out-of-Pocket Costs fairly traceable to the Security Incident.

Medical Data Monitoring Services

The Medical Data Monitoring services will monitor medical and healthcare data to determine whether private medical information is at risk or has been exposed to medical fraud. It includes real-time alerts when suspicious activity is detected and provides up to $1,000,000 of insurance for medical identity theft with no deductible.

Cash Benefit Payment

The Cash Benefit Payment will depend on the participation rate for the Settlement. For example, if 2% of the Settlement Class Members participate, the approximate cash payment would be $141.30. If 10% participate, the payment would be around $28.26.

Out-of-Pocket Costs

Out-of-Pocket Costs can include unreimbursed costs or losses incurred on or after December 29, 2022, such as late fees, declined payment fees, overdraft fees, returned check fees, customer service fees, card cancellation or replacement fees, credit-related costs, and costs to replace a driver’s license, state identification card, or Social Security number.

Is Proof Required to Claim the Reward?

Yes, claimants need to provide proof to claim an award. To claim Out-of-Pocket Costs, you must submit a valid Claim Form with Reasonable Documentation, such as credit card statements, bank statements, invoices, telephone records, and receipts.

If you received a postcard notice by mail, use your Claim Number and Last Name to file your Claim Form online. If you lost or do not know your Claim Number, call the toll-free number 1-877-411-4707 to obtain it.

The deadline to complete and submit a Claim Form is October 7, 2024.

$3,000,000 Settlement Fund Breakdown

The total settlement amount is $3,000,000. This fund will cover Cash Benefit Payments, Out-of-Pocket Costs, attorneys’ fees and expenses, service awards to Class Representatives, taxes on any interest earned by the Settlement Fund, and notice and settlement administration expenses.

The breakdown is as follows:

  • Settlement Fund: $3,000,000
  • Attorneys’ fees and expenses: Up to 33.33% of the Settlement Fund
  • Service awards to Class Representatives: $500 each
  • Out-of-Pocket Costs: Up to $300,000
  • Medical Data Monitoring services: Up to 3 years

What Happens Next?

The Court will hold a Final Fairness Hearing on September 27, 2024, to decide whether to grant final approval of the Settlement. If approved, the Settlement will become final, and payments will be distributed to eligible Settlement Class Members.
