Who Can Claim an Award?

The court has determined that anyone whose personal information was identified by Carvin Wilson Software as potentially exposed in the data breach is a member of the Settlement Class. This includes approximately 189,319 individuals whose data may have been accessed and compromised between February 22, 2023, and March 9, 2023.

What Awards Can Class Members Claim?

Class members can claim various benefits from the settlement, including:

  • Two years of identity theft and credit monitoring services.
  • Compensation for lost time spent remedying issues related to the data breach, at a rate of $20 per hour, up to four hours.
  • Reimbursement for actual, documented out-of-pocket expenses incurred as a result of the data breach, up to $8,500.

For example, if you spent three hours dealing with issues related to the data breach, you could claim $60 (3 hours x $20/hour). If you also incurred $500 in out-of-pocket expenses, you could claim a total of $560.

Identity Theft and Credit Monitoring Services

All Settlement Class Members are eligible to receive two years of identity theft and credit monitoring services.

Compensation for Lost Time

All Settlement Class Members are also eligible to receive compensation of $20.00 per hour, up to four hours, for lost time spent remedying issues related to the Data Breach.

Reimbursement for Out-of-Pocket Expenses

Settlement Class Members who incurred actual, documented out-of-pocket expenses because of the Data Breach are also eligible to receive an additional cash payment up to $8,500.00, depending on the types of expenses they incurred and provided the expenses have not been reimbursed or resolved without payment, the expenses are owed or have been paid by the Settlement Class Member, and the Settlement Class Member made reasonable efforts to avoid or seek reimbursement for the out-of-pocket losses.

If, after paying out all court-approved fees, expenses, and claims, there is sufficient money left over in the settlement fund, all Class Members who filed any type of claim will receive a pro rata share of that remaining money. If, however, the value of the claims is greater than the settlement fund after court-approved fees and expenses have been paid out, then claims will be paid on a pro rata basis as explained in the Settlement.

$825,000 Settlement Fund

The total settlement amount is $825,000. This fund will be used to cover:
