If you received an uninsured or underinsured motorist coverage payment from Trumbull Insurance Company, Hartford Insurance Company of the Southeast, Twin City Fire Insurance Company, Hartford Underwriters Insurance Company, Hartford Insurance Company of the Midwest, or Hartford Casualty Insurance Company, based on the limit of liability for one vehicle, but insured more than one vehicle under your policy, you may be eligible to claim an award from a class action settlement.

Who are the class members?

To be considered a class member, you must meet specific criteria outlined on the official settlement website. Here is a detailed breakdown:

  • You were insured under one of the Defendants' personal lines automobile policies issued in Arizona
  • Your policy provided uninsured or underinsured motorist coverage for more than one vehicle
  • You received a claim payment equal to the limit of liability for one vehicle without being notified of your right to select which vehicle’s coverage was applicable during the Class Period

The class includes individuals who received a payment based on the single vehicle limit of liability during the relevant period. If you meet these conditions, you are automatically considered a class member unless you choose to exclude yourself.

How much can class members get?

The settlement fund will be used to compensate class members proportionally based on their individual damages and the available UM/UIM coverage. After deducting administration expenses, court-ordered attorneys’ fees, litigation expenses, and a service award, the remaining funds will be distributed to class members.

  • Proportional Valuation: Each class member's damages are assessed relative to policy limits and payments already received.
  • Defenses Considered: Certain defenses may reduce the estimated claim payment.

No action to receive compensation

If you are a class member, you do not need to take any further action to receive your share of the settlement. Payments will be automatically sent to eligible class members. If you believe your estimated payment does not fully represent your damages, you may request a review by submitting a Supplemental Recovery form by November 25, 2024.

$13,940,000 Settlement fund

The settlement fund of $13,940,000 will cover various costs associated with the settlement:

  • Settlement Administrator’s costs for notice and administration.
  • Class Counsel’s attorneys’ fees, not to exceed 30% of the Settlement Fund.
  • Reimbursement of up to $60,000 in litigation expenses.
  • A service award of up to $7,500 for the Class Representative.

The remaining funds will be distributed to class members according to the court-approved allocation.

Important dates

  • Deadline to Submit a Supplemental Recovery Form: November 25, 2024
  • Deadline to Exclude Yourself from the Settlement: November 25, 2024
  • Fairness Hearing: December 13, 2024

When is the settlement payout date?

The exact payout date for the settlement has not been specified, but it will occur sometime after the settlement's fairness hearing on December 13, 2024.

Why is there a class action settlement?

This class action lawsuit arose from allegations that the Defendants failed to properly notify insured individuals of their right to select which vehicle’s coverage applied to uninsured or underinsured motorist claims. A recent Arizona Supreme Court decision highlighted that multi-vehicle insurance policies should allow for stacking coverage, which means insureds could recover up to the policy limits for each insured vehicle. To avoid further litigation risks and costs, the parties agreed to settle.
