If you were injured in a collision and Travelers paid you the policy limit for uninsured or underinsured motorist coverage on one vehicle, but your policy also covered additional vehicles, you may be eligible to claim compensation from a class action settlement.

Travelers Property Casualty Insurance Company has agreed to pay $14,970,000 to settle a class action lawsuit. The lawsuit alleges that Travelers failed to provide the required policy language and notice under Arizona law, which affected the payment of uninsured or underinsured motorist claims.

Who are the class members getting payouts?

The class members include individuals insured under a Travelers policy issued in Arizona during the period from September 21, 2016, through October 16, 2024, who:

  • Received a claim payment equal to the limit of liability for the uninsured or underinsured motorist benefits for only one vehicle.
  • Were one of multiple claimants where the aggregate total paid on such claims was equal to the aggregate limit of liability for the uninsured or underinsured motorist benefits for only one vehicle.

These class members are automatically included in the settlement and do not need to file a claim to receive compensation.

How much can class members get?

The settlement fund will be distributed among class members based on their available uninsured or underinsured motorist coverage and their individual damages. The exact amount each class member will receive depends on the net settlement fund, which is the settlement fund minus administration costs, attorneys' fees, and other expenses.

A final calculation cannot be made until after the final approval hearing.

Class members do not need to take any action to receive their share of the settlement. Payments will be sent automatically once the settlement is approved.

$14.97 Million settlement fund

The settlement fund of $14,970,000 will cover various costs associated with the settlement:

  • Settlement administration costs: TBD
  • Attorneys' fees: Up to 30% of the settlement fund
  • Attorneys' expenses: Up to $60,000
  • Service awards to class representatives: Up to $20,000 total
  • Payments to class members: Remaining amount after deductions

Important dates

  • Fairness Hearing: April 2, 2025
  • Deadline to File a Claim: Not applicable

When is the Travelers Uninsured and Underinsured Motorist Settlement payout date?

The final approval hearing will be held on April 2, 2025. If the settlement is approved, payments will be distributed to class members within 75 days after the effective date, which occurs after the final approval and any appeals are resolved.

Why is there a class action settlement?

The lawsuit was filed because Travelers allegedly failed to provide the required policy language and notice under Arizona law, affecting the payment of uninsured or underinsured motorist claims. The settlement resolves these allegations without admitting any wrongdoing.
