What Awards Can Class Members Claim?

Class members can claim a Base Payment of $25, which may increase or decrease depending on the number and type of claims submitted, but will not exceed $50. Additionally, class members who can provide proof of economic losses above the Base Payment amount may be eligible for additional compensation.

To receive the Base Payment, you must submit a Claim Form attesting to your economic loss and residency or business operation in the impacted area during March 2023. For additional compensation, you must provide reasonable documentary proof of your economic losses.

If the award amount is subject to a net settlement fund calculation, the remaining amount after deductions for settlement administration fees, attorneys' fees, and service awards will be distributed to eligible class members. For example, if the Net Settlement Fund is $2,326,845 (after deducting $365,155 for settlement administration fees and $8,000 for service awards), and there are 10,000 valid claims, each claimant would receive approximately $232.68 if all claims were for the Base Payment amount only.

Settlement Fund Breakdown

The total settlement amount is $2,700,000. This fund will cover:

  • Settlement payments to class members
  • Settlement administration fees and costs, estimated at $365,155
  • Attorneys' fees, not exceeding 33 1/3% of the Settlement Fund, plus costs
  • Service awards to the four Class Representatives, totaling up to $8,000
