Allstate Insurance Company has agreed to pay $3,300,000 to settle a class action lawsuit for alleged violations of the California Invasion of Privacy Act (CIPA) by recording outgoing calls to cell phones without consent.
Can I Claim an Award?
To be eligible for a claim, you must have received a call on your cell phone from Allstate’s Claims Liability Determination Unit between February 1, 2022, and December 31, 2022, and did not consent to the call being recorded. This settlement affects individuals who were called during this period and did not receive an advisement at the outset of the call that it may be recorded.

What Awards Can Class Members Claim?
The settlement provides a total amount of $3,300,000 to be distributed among eligible class members who submit valid and timely claims. The exact amount each claimant will receive depends on the total number of valid claims submitted.
If 10% of the approximately 130,005 settlement class members submit a claim, each claimant would receive approximately $244.04. However, this is only a hypothetical, and the actual amount may vary.
- If the number of valid claims increases, the amount each claimant receives will decrease accordingly.
- Class Counsel will seek up to 30% of the settlement fund as payment for attorneys’ fees and costs, and up to $3,000 as a service award to the class representative.
Is Proof Required to Claim the Reward?
