
Individuals in the United States whose personal information the December 2024 QPharma data breach potentially compromised may qualify to submit a claim for up to $5,750 from a class action settlement.
QPharma Inc. agreed to settle a class action lawsuit alleging an unauthorized party accessed personal and private information during a targeted cyberattack in December 2024, potentially exposing individuals to risks such as identity theft or fraud.
Who can file a claim for a data breach payout?
Class members must meet the following criteria:
- The December 2024 QPharma data incident potentially compromised their personal information.
- They resided in the United States at the time of the QPharma data breach.
This includes individuals who received a settlement notice.
How much are settlement payments?
- Ordinary losses: Class members can claim up to $750 for documented out-of-pocket expenses incurred between Dec. 16, 2024, and July 7, 2026. Eligible expenses include fees for credit reports, credit monitoring or freezing/unfreezing credit, costs to replace identification documents and postage to contact financial institutions.
- Extraordinary losses: Class members can claim up to $5,000 for documented losses from identity theft or fraud that are likely traceable to the data breach and not already covered by ordinary losses. Claimants must have attempted to recover the loss through other means, such as insurance.
- Lost time: Class members can claim up to four hours of lost time dealing with the data breach at $20 per hour for a maximum of $80. This may include time spent changing passwords or investigating suspicious activity. The lost time payment amount is included in the ordinary losses cap of $750.
- Credit monitoring services: Class members can elect to receive two years of CyEx Financial Shield Complete. Services include monitoring for fraud or identity theft, unauthorized financial transactions and high-risk activities, $1 million in financial fraud insurance and access to fraud resolution agents.
- Alternate cash payment: Class members who do not submit a claim for ordinary or extraordinary losses, lost time or credit monitoring can submit a claim to receive a one-time cash payment of $50.
How to claim a class action rebate
To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail or email to the settlement administrator.

Required proof or claim information
- Online claims require the unique ID and PIN from the settlement notice the class member received.
- Ordinary losses claims require supporting documentation, such as receipts or proof of expenses.
- Extraordinary losses claims require supporting documentation showing the monetary loss, proof the data breach caused it and evidence of an attempt to recover the funds elsewhere. Proof may include bank or credit card statements showing fees or fraudulent charges, communication showing an attempt to reverse the charges, invoices for accountant or attorney services, police reports or other documentation showing identity theft or fraudulent activity.
