If you reside in the United States and your private information was compromised in the Builders Mutual Data Incident in December 2022, you may be eligible to claim up to $10,000 from a class action settlement.

Builders Mutual Insurance Company has agreed to pay $1,475,000 to settle a class action lawsuit for alleged unauthorized access to their computer systems, which exposed private information of stakeholders, customers, employees of policyholders, current and former employees, and claimants.

The settlement class includes individuals whose personally identifiable information (PII) and protected health information (PHI) were exposed. This includes names, social security numbers, dates of birth, medical information, health insurance information, and worker’s compensation information.

How much can class members get?

Class members have two options for compensation:

  1. Three years of credit monitoring services, compensation for unreimbursed economic losses up to $10,000, and compensation for lost time up to 6 hours at $25 per hour, totaling $150
  2. An estimated $100 cash payment

The credit monitoring services include one-bureau credit monitoring, dark web monitoring, real-time inquiry alerts, and $1,000,000 in identity theft insurance. Unreimbursed economic losses cover out-of-pocket costs related to fraud and identity theft, professional fees, costs associated with freezing or unfreezing credit, and other miscellaneous expenses.

  • Credit Monitoring and Compensation: This option provides three years of credit monitoring, up to $10,000 for unreimbursed economic losses, and up to $150 for lost time.
  • Cash Payment: An estimated $100, which may vary depending on the number of claims filed.

What proof is required to submit a claim?

  • For unreimbursed economic losses, documentation such as receipts is required.
  • For lost time, claimants must attest to the time spent remedying issues related to the data incident.

$1,475,000 Settlement fund

The settlement fund of $1,475,000 will cover various costs:

  • Notice and settlement administration costs.
  • Court-approved attorneys’ fees of $491,617.50 and litigation expenses up to $25,000.
  • Service awards of $5,000 to each of the three class representatives.
  • Compensation to class members who submit valid claims.

When is the Builders Mutual Data Breach payout date?
