Tzumi Innovations Settles Class-Action Lawsuit for $2 Million

In a recent development, Tzumi Innovations, LLC has reached a settlement in the class-action lawsuit Proskin, et al. v. Tzumi Innovations, LLC (No. 22-cv-05919-JSR) filed in the U.S. District Court for the Southern District of New York. The lawsuit alleges that Tzumi Innovations falsely and misleadingly marketed Wipe Out! Products as safe and legal surface disinfectants in violation of state and federal law. Tzumi Innovations, LLC denies these allegations.

What's the Total Settlement Amount?

The proposed settlement creates a $2 million settlement fund. This fund will be utilized to pay Class Member claims, notice and administration fees, attorneys' fees, costs, and service awards to class representatives.

What are the Important Dates to Remember?

There are several important dates that class members should be aware of. The deadlines to exclude yourself from the Settlement, to object or comment on the Settlement, and to submit a Claim Form have not been specified yet. The final approval hearing date is also yet to be announced.

Who are the Class Members?

Class Members are individuals who purchased Wipe Out! Products in the United States on or before April 19, 2023. The class does not include judges and magistrates presiding over the lawsuit, their families, Tzumi Innovations, LLC and its subsidiaries, parent companies, and entities in which Tzumi Innovations, LLC or its parents have a controlling interest, as well as their current or former officers, directors, agents, attorneys, and employees.

What's the Award for Class Members?

Eligible Class Members can submit a claim for a cash payment from the Settlement Fund. Class members who submit a valid claim can receive a cash award of $3 per purchased product with proof of purchase, up to $15.00, or $2.00 per purchased product without proof of purchase, up to $6.00. If the total amount of valid claims exceeds the available settlement fund, the payments to class members will be proportionally decreased.
