Individuals whom the St. Louis Medium Security Institution detained for three or more consecutive days between Nov. 13, 2012, and June 30, 2022, may be eligible to submit a claim for a cash payment from a class action settlement.

The City of St. Louis agreed to pay $4 million to settle a class action lawsuit alleging it subjected detainees at its medium security institution to unconstitutional and inhumane conditions. The plaintiffs claimed these individuals experienced extreme temperatures, poor ventilation, sewage overflows, pest infestations, mold and overcrowding.

Who are the class members?

Class members must meet the following criteria:

  • The St. Louis Medium Security Institution detained them.
  • Their detention lasted three or more consecutive days between Nov. 13, 2012, and June 30, 2022.
  • During their detention, they allegedly experienced inhumane conditions, including at least one of the following:
    • Extreme temperatures
    • Poor ventilation
    • Overflowing sewage
    • Insect or rodent infestations
    • Mold
    • Overcrowding

How much will settlement payments be?

Pro rata cash payment: Class members can submit a claim to receive a pro rata cash payment from the net settlement fund. The settlement administrator will determine the final payment amount by the total eligible detention days all eligible class members claim.

To receive a settlement payment, class members can file a claim online or print the PDF claim form to mail or email to the settlement administrator.

Required claim information

  • To submit an online claim, class members must provide either the claimant ID from the settlement notice they received and their last name, or the last four digits of their Social Security number and their birth date.
  • To submit a paper claim form, class members must provide the claimant ID from the settlement notice they received.
  • Class members whose name changed since they were in custody must include a legal document copy, such as a marriage or divorce certificate.
  • Individuals submitting a claim on behalf of a deceased class member must include a death certificate copy and legal documentation showing they have authority to act on their behalf.

Payout options

The settlement administrator will mail a paper check to the address the class member provides on the claim form.

$4 million settlement fund breakdown

The $4,000,000 settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys' fees and expenses: Up to $1,333,220
  • Service awards to class representatives: $10,000 each ($60,000 total)
  • Payments to approved claimants: Remaining settlement funds

When is the St. Louis Medium Security Institution settlement payout date?

The settlement administrator will issue payments to approved claimants approximately 90 days after the court grants final approval of the settlement.
