  • You are a current or former courier driver employed by Sidwell Air Freight, Inc.
  • You worked in Washington from December 14, 2018, to February 27, 2024, or in Utah, Arizona, Oregon, Idaho, New Mexico, or Texas from January 26, 2020, to February 27, 2024.
  • You delivered packages for DHL Express (USA) Inc. during the specified periods.
  • You worked more than 40 hours in any workweek without receiving proper overtime compensation.

How much can class members get?

The settlement awards will be distributed from the Net Settlement Amount, which is calculated after deducting attorneys' fees, costs, and service awards from the Gross Settlement Amount. Each participating class member will receive a minimum of $300, with additional amounts calculated based on the number of weeks worked.

The formula for calculating the pro rata portion is:

  • Individual Settlement Award = $300 + Pro Rata Portion
  • Pro Rata Portion = (Individual Settlement Shares \* Per Share Dollar Figure)

The Per Share Dollar Figure is determined by dividing the total number of Individual Settlement Shares across all participating members into the Net Settlement Fund.

For example, if a class member worked 10 weeks in Washington, they would receive 15 shares (10 weeks \* 1.5), and if the Per Share Dollar Figure is $10, their pro rata portion would be $150, making their total award $450.

$1,000,000 Settlement Fund Breakdown

The settlement fund of $1,000,000 will cover:

  • Attorneys' fees: $333,333.33
  • Settlement administration costs: up to $17,250
  • Service awards for Named Plaintiffs: $5,000 each, totaling $15,000

The remaining funds will be distributed to participating class members based on the pro rata calculation.
