Revance Therapeutics, Inc. has agreed to settle a class action lawsuit for alleged unauthorized access to their systems and files containing sensitive personal information.

Can I Claim an Award?

You are a Settlement Class Member if you were mailed written notification by Revance Therapeutics, Inc. that your private information was potentially compromised due to the data incident discovered in April 2023. This includes information such as names, addresses, dates of birth, Social Security numbers, driver’s license numbers, bank account numbers, treatment information, and health insurance information.

What Awards Can Class Members Claim?

The proposed settlement will provide several benefits to Settlement Class Members:

  • Documented out-of-pocket expense reimbursement up to $1,000 for expenses incurred as a result of the data incident, including unreimbursed bank fees, long-distance phone charges, cell phone charges (if charged by the minute), data charges (if charged based on the amount of data used), postage, gasoline for local travel, and fees for credit reports, credit monitoring, or other identity theft insurance products purchased between March 15, 2023, and the claims deadline.
  • Reimbursement for up to three hours of lost time spent dealing with the data incident at the rate of $25 per hour, provided at least one full hour was spent.
  • Reimbursement for extraordinary losses up to $2,500 for documented monetary loss that is actual, documented, and unreimbursed, was more likely than not caused by the data incident, occurred between March 15, 2023, and the claims deadline, and is not already covered by other reimbursement categories.
  • One year of credit monitoring with an additional $1 million in insurance for any eligible damages.

Documented Out-of-Pocket Expense Reimbursement

Settlement Class Members can claim up to $1,000 for documented out-of-pocket expenses. These expenses must be directly related to the data incident and can include:

  • Unreimbursed bank fees
  • Long-distance phone charges
  • Cell phone charges (if charged by the minute)
  • Data charges (if charged based on the amount of data used)
  • Postage
  • Gasoline for local travel
  • Fees for credit reports, credit monitoring, or other identity theft insurance products purchased between March 15, 2023, and the claims deadline.

Lost Time Reimbursement

Class Members can also claim reimbursement for up to three hours of lost time spent dealing with the data incident, calculated at $25 per hour. To qualify, at least one full hour must have been spent. The total reimbursement for lost time and out-of-pocket expenses combined cannot exceed $1,000.

Documented Extraordinary Loss Reimbursement

For extraordinary losses, Class Members can claim up to $2,500. These losses must be:

  • Actual, documented, and unreimbursed
  • More likely than not caused by the data incident
  • Occurred between March 15, 2023, and the claims deadline
  • Not already covered by out-of-pocket expenses or lost time reimbursement

Credit Monitoring

Class Members are also eligible for one year of credit monitoring, which includes an additional $1 million in insurance for any eligible damages. Revance will cover the cost of these services separately from other settlement benefits.

Is Proof Required to Claim the Reward?

Yes, claimants need to provide proof to claim an award. This includes necessary supporting documentation for out-of-pocket expenses, a written description of how the claimed lost time was spent related to the data incident, and documentation of extraordinary losses along with proof of reasonable efforts to avoid or seek reimbursement for the loss.

How to Claim Your Award

To claim your award, you must file a claim form. You can submit your claim online by visiting the online claim form or by mailing your claim to the settlement administrator at the following address:

Claim forms must be submitted online by 11:59 p.m. PT on August 28, 2024, or postmarked no later than August 28, 2024.

How do I Get Paid?

Once your claim is approved, you will receive your payment via the method you selected on your claim form. Options may include check or electronic payment.

When will Awards be Paid?

Awards will be paid after the Court grants final approval of the settlement and any appeals are resolved.
