Real Good Foods $1,250,000 TCPA Class Action Settlement

If you received a text message from Real Good Foods or anyone on their behalf, regarding the company's goods, products, or services, to your residential telephone number after making a request to stop receiving such messages, you may be eligible to receive up to $25 from a class action settlement.

Real Good Foods, LLC has agreed to pay $1,253,159.25 to settle a class action lawsuit for alleged violations of the Telephone Consumer Protection Act (TCPA).

Can I Claim an Award?

To be eligible for an award, you must:

• within the four years, received a text message from Real Good Foods or anyone on their behalf, regarding the company's goods, products, or services, to their residential telephone number
• made a request to Real Good Foods, LLC to stop receiving such messages.
• Live in the United States

What Awards Can Class Members Claim?

Class Members can choose to receive their payment in either cash or a voucher.

• Cash Payment: Up to $8.25 per Settlement Class Member.
• Voucher: Worth $25.00, can be used to purchase Real Good Foods, LLC products.

Is Proof Required to Claim the Reward?

No direct proof is required to claim the reward. However, settlement Class Members must submit a Claim Form that includes a signed statement _under penalty of perjury_ confirming that they received one or more text messages from Real Good Foods, LLC and are members of the Settlement Class.

How to Claim Your Award

To claim your award, you must complete and submit a valid Claim Form. You can download the Claim Form from the official settlement website or request one by calling the toll-free number. The Claim Form must be fully and accurately completed and submitted by U.S. Mail or through the settlement website. The deadline to submit the Claim Form is July 30, 2024.

You can file a claim online or mail your completed Claim Form to the Claims Administrator at the address provided.

How Do I Get Paid?

Payments will be made by check to Settlement Class Members who submit valid Claim Forms. The checks will be sent to the address provided on the Claim Form within 60 days following the Effective Date of the Settlement.

$1,253,159.25 Settlement Fund Breakdown

The total settlement amount is $1,253,159.25. This amount will cover payments to Settlement Class Members, Notice and Administration Costs, Attorneys’ Fees and Expenses, and a Service Award for the Plaintiff.

Class Counsel intends to request up to $400,000 for attorneys’ fees plus reasonable, actual out-of-pocket expenses incurred in the litigation. The Plaintiff will also request a Service Award of up to $10,000 for their role as Class Representative.

Why Is There a Class Action Settlement?

The lawsuit alleges that Real Good Foods, LLC sent text messages to individuals' wireless telephone numbers after they had asked the company to stop, in violation of the TCPA. The settlement avoids the costs and uncertainty of a trial, and if approved by the Court, will provide benefits to Settlement Class Members.

The next steps include the Final Approval Hearing, where the Court will decide whether the settlement is fair, reasonable, and adequate. If the settlement is approved, payments will be distributed to eligible Settlement Class Members who submit valid Claim Forms.
