If you applied or attempted to apply for a consumer credit product with Noble Credit Union and your application for membership was denied since January 5, 2022, you may be eligible to claim $3,000 from a class action settlement.

Noble Credit Union has agreed to pay $159,000 to settle a class action lawsuit for alleged discrimination against applicants based on immigration status or lack of U.S. citizenship.

Who are the class members?

The class members include individuals who:

  • Applied for or attempted to apply for an automotive loan with Noble Credit Union
  • Used a 'limited term' California driver's license, including but not limited to DACA recipients
  • Were denied the loan based on immigration status and/or lack of U.S. citizenship

How much can class members get?

Each class member who does not opt out will receive a payment of $3,000. The total settlement fund is $159,000, which will be distributed equally among all eligible class members.

This amount is fixed and not subject to any pro rata calculations, meaning each member will receive the same amount regardless of the number of claims.

If you are a class member, you do not need to take any action to receive your payment. The Settlement Administrator will automatically send a check to eligible class members unless they choose to opt out.

Payment methods

Payments will be made via mailed checks to the class members.

$159,000 Settlement fund

The settlement fund of $159,000 will cover payments to class members, with each receiving $3,000. The settlement also includes fees for Class Counsel, which are not deducted from the settlement fund.

  • Class Counsel Fees: Estimated at $50,000.
  • Named Plaintiff Service Award: $5,000.

When is the Noble Credit Union payout date?

The Court will hold a Fairness Hearing on December 18, 2024, to decide whether to approve the settlement. If approved, payments will be mailed 40 days after the Court approves the settlement, provided there are no appeals.

Why is there a class action settlement?

The lawsuit alleges that Noble Credit Union violated the California Unruh Civil Rights Act by denying automotive loan applications based on immigration status and/or lack of U.S. citizenship. The parties settled to avoid the expense and uncertainty of continued litigation.
