NABP $831,800 Settlement: Understanding Your Rights and Benefits

The National Association of Boards of Pharmacy (NABP) has reached a proposed settlement in a class action lawsuit, which may significantly impact individuals who took the North American Pharmacist Licensure Examination (NAPLEX) and received incorrect scoring notifications. If you're among those affected, it's crucial to understand your eligibility for compensation and the steps you need to take to claim your award.

Who Benefits?: Individuals who received incorrect NAPLEX score notifications during specified periods in 2021 and 2022.

How much can I get?: Settlement awards vary from $100 to $7,500, depending on specific criteria related to the NAPLEX test and subsequent licensure examinations.

Important Dates

  • Final Approval Hearing: The Court will hold a hearing on February 14, 2024, to decide on the settlement's final approval.
  • Deadline to File a Claim: You must submit your claim by January 12, 2024, to be eligible for a settlement payment.

Identifying Eligible Class Members

The settlement class includes two distinct groups based on the time they took the NAPLEX test and received incorrect score notifications. The 2021 Class consists of those who took the exam between August 31, 2021, and September 8, 2021, and were informed of a false failure. The 2022 Class includes individuals who took the exam from July 30, 2022, through October 26, 2022, and received incorrect score reports.

  • 2021 Class: Candidates who received incorrect 'failed' notifications after taking the NAPLEX between August 31, 2021, and September 8, 2021.
  • 2022 Class: Candidates who received incorrect score notifications after taking the NAPLEX between July 30, 2022, and October 26, 2022.

Certain individuals are excluded from the Settlement Class, such as NABP's in-house or outside counsel and their immediate family members, NABP employees, members of the judiciary assigned to the action, and any candidate whose claims have already been resolved.

Understanding the Settlement Awards

The Proposed Settlement provides compensation only to those who submit valid claims by the deadline. The total settlement fund is capped at $831,800, and the amount each class member can receive depends on several factors, including when they took the NAPLEX and whether they passed subsequent licensure examinations.

  • 2021 Class Members: Payments range from $100 to $500.
  • 2022 Class Members: Payments range from $1,000 to $7,500.

The Examination in Question

The settlement concerns the NAPLEX, a crucial step for pharmacists seeking licensure in the United States. The incorrect scoring of this exam is at the heart of the lawsuit and the resulting settlement.

Is Proof Required to Claim the Reward?

No documentation is required to submit with your Claim Form. The form will guide you through the necessary information you need to provide.

How to Claim Your Award

To claim your settlement payment, you must submit a completed and signed Claim Form by the deadline of January 12, 2024. You can file your claim online at Submit Your Claim or mail it to the Settlement Administrator. If mailing, ensure it is postmarked by the deadline.

Deciphering the Settlement Amount

The total settlement amount agreed upon is $831,800. This sum will be distributed among valid claims, reduced by any court-awarded attorneys' fees.

Why Settle the Class Action?

The decision to settle reflects a mutual agreement to avoid the expenses and risks associated with continued litigation. The settlement provides a mechanism for compensating those affected by the alleged negligent scoring of the NAPLEX exam.

With the settlement, class members gain the opportunity to receive compensation without the need for a trial, while NABP is able to resolve the claims against it.
