Can I Claim an Award?

The settlement class includes any patient, client, insurance company, or attorney who, between December 1, 2010, and July 5, 2017, paid for copies of medical records from West Virginia medical providers that were invoiced and/or billed by MRO Corporation, CIOX Health, LLC, HealthPort Technologies, LLC, or Medi-Copy Services, Inc. This includes those who paid directly or reimbursed their attorney for the payment.

The class is divided into four subclasses:

  • Subclass 1: Requests from December 1, 2010, to June 5, 2014, from patients, insurance companies, or attorneys.
  • Subclass 2: Requests from June 6, 2014, to July 5, 2017, from patients.
  • Subclass 3: Requests from June 6, 2014, to July 5, 2017, from attorneys and insurance companies.
  • Subclass 4: Requests from June 6, 2014, to July 5, 2017, from patients, insurance companies, or attorneys who paid a retrieval fee.

What Awards Can Class Members Claim?

Class members can claim different amounts based on the subclass they belong to:

  • Subclass 1: Difference between the per-page fee paid and $0.50 per page.
  • Subclass 2: Difference between the per-page fee paid and $0.12 per page.
  • Subclass 3: Difference between the per-page fee paid and $0.28 per page.
  • Subclass 4: Full reimbursement of the retrieval fee.

Is Proof Required to Claim the Reward?
