Indianapolis Neurosurgical Group d/b/a Goodman Campbell Brain and Spine (GCBS) has agreed to settle a class action lawsuit related to a May 2022 data breach exposing sensitive personal information of 264,218 current or former employees and patients.

Can I Claim an Award?

You are a Settlement Class Member if you resided in Indiana at the time of the data breach and received written notification that your social security number was potentially accessed, viewed, and/or obtained.

What Awards Can Class Members Claim?

The proposed Settlement will provide the following benefits to Settlement Class Members:

  • Documented Out-of-Pocket Expense Reimbursement (Ordinary Losses): not to exceed $375
    • Unreimbursed bank fees
    • Long distance phone charges
    • Cell phone charges (only if charged by the minute)
    • Data charges (only if charged based on the amount of data used)
    • Postage
    • Gasoline for local travel
    • Fees for credit reports, credit monitoring, or other identity theft insurance products purchased between May 17, 2022, through July 29, 0224 (the claims deadline)
  • Lost Time Reimbursement for up to four hours of lost time spent dealing with the breach, at $20 per hour, for a total of up to $80 if you
    • Attest that any claimed lost time was spent responding to issues raised by the Data Incident.
    • Provide a written description (or checkbox style description) of how the claimed lost time was spent related to the Data Incident.
    • Claims made for lost time can be combined with reimbursement for out-of-pocket expenses and are subject to the same $375 cap for all Settlement Class Members.
  • Documented Extraordinary Loss Reimbursement: not to exceed $5,000
    • Is actual, documented, and unreimbursed.
    • Was more likely than not caused by the Data Incident.
    • Occurred between May 17, 2022, and July 29, 2024.
    • Is not already covered by any of the above-referenced documented out-of-pocket expenses or lost time reimbursement categories.

Settlement Class Members must also provide documentation that they made reasonable efforts to avoid, or seek reimbursement for, the loss, including but not limited to exhaustion of all available credit monitoring insurance and identity theft insurance.

Credit Monitoring

If you would like to claim two (2) years of credit monitoring, you may do so before the Claims Deadline on July 29, 2024, by selecting the credit monitoring option on the Claim Form.

Is Proof Required to Claim the Reward?

Yes, proof is required to claim a reward. Claimants need to provide documentation to support their claims for reimbursement of out-of-pocket expenses, lost time, or extraordinary losses. Documents should be clear, readable copies, as anything you submit will not be returned to you. You may redact unrelated transactions and all but the first four and last four digits of any account number (if applicable).

  • Unreimbursed Bank Fees: Examples include overdraft fees, over-the-limit fees, late fees, or charges due to insufficient funds or interest.
  • Other Incidental Telephone, Internet, Postage, or Gasoline (For Local Travel Only) Expenses: Examples include long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used).
  • Credit Reports, Identity Theft Insurance, or Credit Monitoring Charges: Examples include the cost of a credit report, identity theft insurance, or credit monitoring services that you purchased between May 17, 2022, and July 29, 2024.

How to Claim Your Award

To claim your award, you must file a Claim Form. Claim Forms must be submitted online by 11:59 p.m. July 29, 2024, or postmarked no later than July 29, 2024.

How Do I Get Paid?

After submitting your completed claim online, you will receive an email with a confirmation code for your completed submission. Be sure to keep your confirmation email and code and refer back to them if you have any questions about your Claim Form. If additional information is required to complete your claim, you will be contacted by the Settlement Administrator.
