ESO Solutions, Inc. (known as eCore Solutions) has agreed to pay $4,101,300 to settle a class action lawsuit for alleged violations of the Illinois Biometric Information Privacy Act (BIPA). The lawsuit claims that ESO failed to obtain informed consent before collecting biometric data and did not adhere to a data destruction policy.
Who are the class members?
The class members include individuals who:
- Scanned their finger using an ePro BioClock in Illinois
- Had their finger-scan data hosted on a server owned or leased by ESO from January 24, 2017, to September 10, 2024
This settlement does not cover individuals who used an ePro BioClock but did not have their data hosted on ESO's servers.
How much can class members get?
Class members can expect to receive approximately $401. This amount is an estimate and depends on the total number of claims, administrative costs, and other expenses deducted from the settlement fund.
- Initial Settlement Award Checks: Estimated at $401 per class member.
- Subsequent Distribution: Any remaining funds will be distributed to those who cashed their initial checks, provided the amount is at least $5.
The settlement fund is subject to a net settlement fund calculation. Here's how it works: The total settlement fund of $4,101,300 will first cover administrative costs, attorneys' fees, and a service award to the plaintiff. The remaining amount will be distributed among the class members.
If there are funds left after the initial distribution, they will be redistributed to those who cashed their checks, as long as the amount is at least $5 per person.
Class members do not need to take any action to receive their compensation.

- Cash payments to settlement class members
- Attorneys' fees and expenses: $1,463,024.88 (36%)
- Service award to the plaintiff: $10,000
