If you made a purchase at a DFS retail location in the United States using a credit or debit card between May 27, 2020, and June 30, 2022, you may be eligible to collect up to $17 from a class action settlement.

Can I Claim an Award?

The Settlement Class includes all persons in the United States who meet the following criteria:

• Merchant: DFS retail location
• Country: United States
• Payment method: Debit or credit card
• Timeframe: May 27, 2020, and June 30, 2022

To be eligible, the receipt provided must have displayed the first six and last four digits of your card number.

If you received an email or postcard about this settlement, it is because records indicate you might be a class member. The Claims Administrator will verify your information against DFS transaction data to confirm eligibility.

How Much Can Class Members Claim?

• Up to $17

Class members who submit a valid claim form by July 16, 2024, will receive a pro rata payment from the $2,500,000 Settlement Fund. The final payment amount will depend on the number of valid claims submitted but will not exceed $17.00 per class member.

Is Proof Required to Claim the Reward?

Yes, proof is required. The Claims Administrator will verify the last four digits of your payment card provided on the claim form against DFS transaction data. If the information does not match, you will not be eligible for a settlement payment.

How do I Get Paid?

Payments will be made to eligible class members after the court approves the settlement and any appeals are resolved. The payment method will be determined by the Claims Administrator.

$2,500,000 Settlement Fund Breakdown

The $2,500,000 Settlement Fund will cover payments to class members, attorneys' fees, reasonable expenses, an incentive payment to the plaintiff, and the costs of notice and administration of the settlement. Class Counsel will request up to 33% of the Settlement Fund for attorneys' fees and reasonable expenses, and an incentive payment of $10,000 to the plaintiff.
