Costco Kirkland Signature Flushable Wipes $2M Settlement

If you are an individual over the age of 18 who resides in the United States and purchased Kirkland Signature Moist Flushable Wipes in the State of New York between July 1, 2011, and May 31, 2017, you may be eligible to claim up to $55.90 from this class action settlement.

Costco Wholesale Corporation has agreed to pay $2,000,000 to settle a class action lawsuit for alleged false advertising of their Kirkland Signature Moist Flushable Wipes. The lawsuit claims that the product was not actually flushable and caused damage to plumbing systems.

Can I Claim an Award?

To qualify, the purchase must have been made for personal use and not for resale.

Members of the Settlement Class include those who currently maintain a Costco membership and those who do not. If you currently have a Costco membership, you will automatically receive a payment based on the number of packages purchased. If you do not have a Costco membership, you must submit a valid claim to receive a payment.

What Can I Get in the Settlement?

Each Settlement Class Member is entitled to a payment of $1.30 per package of Kirkland Signature Moist Flushable Wipes purchased during the Settlement Class Period. The minimum payment is $7.50 per household, regardless of the number of packages purchased, and the maximum payment is $55.90 per household. Only one claim may be submitted per household.

For example, if you purchased 10 packages, you would receive $13.00 (10 packages x $1.30). If you purchased 5 packages, you would receive the minimum payment of $7.50. If you purchased 50 packages, you would receive the maximum payment of $55.90.

Is Proof Required to Claim the Reward?

No proof of purchase is required to claim the reward. Settlement Class Members will be eligible to receive their settlement sums regardless of whether their claims are corroborated by proofs of purchase.

How to Claim Your Award

If you do not currently maintain a Costco membership, you must fill out the claim form available at file a claim online. You can also print the claim form and mail it to the Claims Administrator at Kurtz v. Kimberly-Clark Corp. Claims Administrator, P.O. Box 301134, Los Angeles, CA 90030-1134. Claim forms must be submitted online or received by mail by August 9, 2024.

If you currently maintain a Costco membership, you do not need to submit a claim. Costco will identify Settlement Class Members and the number of product units purchased and issue the appropriate check to the mailing address on file.

How do I Get Paid?

• Costco Members: Payments will be made by check and sent to the mailing address on file
• Non-Costco members: Those who submit a valid claim will receive their payment by check to the address provided in their claim form.

$2,000,000 Settlement Fund Breakdown

The total settlement amount is $2,000,000. This amount includes payments to Settlement Class Members, class settlement administration costs, attorneys' fees, and an award to the named plaintiff.

Class Counsel may apply for up to $3,000,000 in attorneys' fees and expenses, to be paid by Costco and Nice-Pak. The named plaintiff, Dr. D. Joseph Kurtz, may receive an award of $10,000 for his time and effort in pursuing the lawsuit on behalf of the Settlement Class.

Why There is a Class Action Settlement
