What Awards Can Class Members Claim?

Class members can claim reimbursement for out-of-pocket losses or an alternative cash payment. Additionally, eligible California residents can receive an extra payment.

Out-of-pocket losses can be claimed up to $10,000 per claimant for expenses directly traceable to the data incident. This includes bank fees, phone charges, costs for credit reports, and actual fraud that occurred between the date of the data incident and August 27, 2024.

If the amount of valid claims for Out-of-Pocket Losses exceeds the limit for all claimants under the settlement, then each payment will be reduced pro rata until all payments total the limit for all claimants.

For example, if the total valid claims amount to $7,000,000 but the settlement fund is only $6,490,000, each claim will be reduced proportionally.

$6,490,000 Settlement Fund Breakdown

The settlement amount is $6,490,000. This fund will cover payments to class members, attorneys' fees, costs of notice and administration, and service awards to class representatives.

Class counsel will request up to one-third of the settlement fund for attorneys' fees, plus reasonable expenses. Service awards of up to $2,500 will be requested for each of the four class representatives.
