
Individuals who received a notice stating the November 2024 Concord Orthopaedics data breach may have compromised their private information could be eligible to claim up to $3,100 from a class action settlement.
Concord Orthopaedics Professional Association agreed to settle a class action lawsuit alleging a targeted cyberattack in November 2024 affected 72,815 people.
The lawsuit claimed Concord Orthopaedics failed to adequately protect sensitive personal information, including names, dates of birth, Social Security numbers, appointment details, health insurance information and driver’s license or state identification numbers.
Who can file a Concord Orthopaedics data breach claim?
The class includes U.S. residents who received a notification from Concord Orthopaedics stating the November 2024 data breach compromised their information. This includes both adults and minors.
How much are the data breach settlement payouts?
Class members can claim several types of benefits and/or payouts depending on their circumstances and the documentation they provide.
- Documented losses: Up to $3,000 for actual, documented out-of-pocket losses related to identity theft or fraud resulting from the data breach. Eligible expenses include:
- Losses from identity theft or fraud
- Fees for credit reports, credit monitoring or freezing/unfreezing credit
- Costs to replace IDs
- Postage for contacting banks or other institutions
- Lost time: Up to four hours at $25 per hour (maximum $100) for time spent responding to the breach, such as changing passwords, investigating suspicious activity or researching the data breach
- Alternate cash payment: A one-time $50 payment as an alternative to the lost time claim
- Medical data monitoring: One year of CyEx Medical Shield Complete, which includes $1 million in medical identity theft insurance and monitoring for health care insurance ID exposure, medical record number exposure and unauthorized health savings account spending
Class members may claim either the lost time payment or the alternate cash payment but not both.
How to claim settlement benefits and payouts
To receive compensation or benefits, class members must submit a claim form by July 8, 2026. The fastest way to file is through the online claim form. Alternatively, class members can download and print a PDF claim form, complete it and mail or email it to the settlement administrator.

Information and documentation required
- To file an online claim form, class members must log in with the unique ID and PIN located on the settlement notice they received.
- To file a documented losses claim, class members must provide proof, such as bank statements, receipts or other supporting documents. Self-prepared notes alone are not sufficient.
- To file a lost time, alternate payment or credit monitoring claim, class members must select the appropriate option on the claim form. They do not need to provide documentation.
Claim instructions
- Visit the online claim form or download the PDF claim form.
- Enter the class member's name, address, email and phone number. Include the class member ID if known.
- Select the benefits the class member wishes to claim: medical data monitoring, reimbursement for documented losses, lost time or alternate cash payment.
- If claiming documented losses, list each expense and attach supporting documentation.
- Choose the preferred payment method: PayPal, Venmo, Zelle, virtual prepaid card or physical check.
- Sign and date the claim form, attesting that the information is true and correct.
- Submit the claim form online or by mail or email to the settlement administrator using the information above.

Settlement fund distributions
