If you participated in the Clean Harbors Savings and Retirement Plan at any time from April 10, 2016, through August 26, 2024, you may be eligible to claim a portion of a class action settlement.

Clean Harbors Environmental Services, Inc. has agreed to pay $395,000 to settle a class action lawsuit for alleged violations of the Employee Retirement Income Security Act of 1974 (ERISA).

Who are the class members?

You are a class member eligible for the settlement if:

  • You participated in the Clean Harbors Savings and Retirement Plan at any time during the Class Period.
  • You are a beneficiary of a deceased individual who participated in the Plan during the Class Period.
  • You are an alternate payee of a participant subject to a Qualified Domestic Relations Order (QDRO) who participated in the Plan during the Class Period.

The Class Period spans from April 10, 2016, to August 26, 2024.

How much can class members get?

The Net Settlement Fund, which remains after court-approved deductions for attorneys' fees, costs, and other expenses, will be distributed among eligible class members. The exact amount each member receives will depend on the records maintained by the Plan’s recordkeeper and the court-approved Plan of Allocation.

  • Attorneys’ Fees and Costs: Up to $131,666.
  • Litigation Expenses: Not exceeding $55,000.
  • Case Contribution Award: Up to $5,000 for the Named Plaintiff.

The remaining amount will be distributed to class members. For example, if the total deductions amount to $191,666, the Net Settlement Fund would be $203,334. This amount will be divided among eligible participants based on their account records.

Class members are not required to submit a claim form.

The distribution process is automated:

  • Current Participants: Those with a positive balance in their Plan account will have their settlement payment deposited directly into their account.
  • Former Participants: Those without an active account will receive their payment via check.

When is the Clean Harbors ERISA Settlement payout date?

The Court will hold a Fairness Hearing on December 12, 2024, to determine whether to approve the Settlement. If approved, payments will be distributed to eligible class members if there are no appeals.

Why is there a class action settlement?

The lawsuit alleged that Clean Harbors breached its fiduciary duties under ERISA. Although Clean Harbors denies these allegations, both parties agreed to settle to avoid the costs and risks associated with litigation. This settlement allows affected participants to receive compensation without the uncertainty of a trial outcome.
