ASP Aesthetics $1.32M Unwanted Text Message Settlement

Individuals who received a text message from ASP Aesthetics, doing business as Chapter Aesthetic Studio, after they asked it to stop sending messages may be eligible to submit a claim for up to $550 from a class action settlement. The settlement class includes an estimated 4,891 people.

ASP Aesthetics LP agreed to pay $1.32 million to resolve a class action lawsuit that alleged it sent marketing text messages to individuals after they requested not to receive additional messages. The plaintiff claimed these actions violated the Telephone Consumer Protection Act.

Who can file a claim for a TCPA payout?

Class members must meet the following criteria:

  • They are located in the United States.
  • They asked ASP Aesthetics, doing business as Chapter Aesthetic Studio, to stop sending text messages at anytime between April 4, 2021, and Feb. 10, 2026.
  • They received one or more text messages from ASP Aesthetics or its agents to their cellular phone after they made the opt-out request.
  • The text message(s) promoted ASP Aesthetics or its agents, goods, products or services.

How much will settlement payments be?

Cash payment per text message: Class members can submit a claim to receive a pro rata cash payment of up to $55 per qualifying text message for up to 10 text messages ($550 maximum).

  • Qualifying text messages are messages the class member received after requesting not to receive any further messages.
  • The settlement administrator will determine the final payment amount by the total number of claims filed.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

Required claim information

The $1,319,450 settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys’ fees and expenses: Up to $435,418.50
  • Service award to class representative: Up to $5,000
  • Payments to approved claimants: Remaining settlement funds

When is the ASP Aesthetics TCPA settlement payout date?

The settlement administrator will mail payments to approved claimants within 60 days after the court grants final approval of the settlement.
